The 3 % per annum and inflation losses remain in Article 625(2) of the Civil Code, and the creditor can claim them even if the contract says nothing about them. What has changed is the penalty: the Civil Code itself now sets it at double the NBU discount rate for late performance of a monetary obligation, while the contract may provide for a lower rate (Civil Code, Art. 549(3), second paragraph). The Civil Code has no six-month cap on the penalty like the one in Article 232(6) of the Commercial Code.

But if the delay began while the Commercial Code was still in force, the Supreme Court still calculates the penalty under the old rules, even in 2026. Inflation losses compensate for the depreciation of the debt and are not a payment for the use of funds, while 3 % per annum is a statutory payment for the use of money that should have reached the creditor (Grand Chamber of the Supreme Court, 2 July 2025, No. 903/602/24, paras 115, 159). That is why they are claimed alongside the penalty. Debt recovery through the courts starts with this calculation: the Commercial Procedure Code requires the statement of claim to set out the value of the claim and a substantiated calculation of each amount (Art. 162(3)(3)), and the value of a claim made up of several demands equals their total (Art. 163(1)(3)).

A hypothetical example: UAH 500,000 of debt and 213 days of delay

Suppose a supply contract was signed in September 2025, after the Commercial Code had already been repealed. The Grand Chamber of the Supreme Court confirmed this cap back in 2019 (No. 904/4156/18), and the CmCC SC reiterated it after the Commercial Code was repealed (No. 910/16298/24).

The contract is silent

If the contract was signed on or after 28 August 2025, the creditor may claim the statutory penalty of double the discount rate (Civil Code, Art. 549(3), second paragraph).

If the delay began while the Commercial Code was still in force, the CmCC SC applies its provisions as worded at the time (Civil Code, Art. 5; ruling of 26 March 2026 in case No. 910/14479/23 (910/5871/24)). Under those rules, the penalty stops accruing six months after the day payment was due (Commercial Code, Art. 232(6)), unless the contract sets a different period: in that case the contract provided for a penalty “until full settlement”, and the court did not apply the cap. In July 2026, in a case about a contractual fine, the CmCC SC rejected the argument that the Commercial Code was no longer in force at the time of the judgment: if a right arose and began to be exercised under the old law, its exercise is completed under the same rules (No. 911/437/25).

We have not found a direct Supreme Court conclusion for a contract signed before 28 August 2025 where the delay began after that date: Article 5(3) of the Civil Code points to the new rules, while ruling No. 911/437/25 can be cited in favour of the old ones. There is no universal percentage: the Joint Chamber of the CmCC SC did not depart even from the conclusion in a case where the neustoika had been reduced by 99 % (No. 920/437/22). But it pointed out that the court may reduce neustoika, not release the debtor from it (No. 911/2269/22). The grounds for reduction are usually proved by the debtor, although one panel of the CmCC SC allowed the court to reduce neustoika on its own initiative as well (No. 910/16193/24). In July 2026 the CmCC SC upheld a decision that had halved a fine, in part because martial law had in practice prevented the defendant from operating at the airport (No. 911/437/25). For January–August: 106.1 %.

July and August 2025 and June 2026 are months of deflation. As a self-check: the product of the indices from September 2025 to August 2026 is 108.07 %, which matches the 8.1 % annual inflation that the NBU reported for August 2026. As of 5 October, there is no index for September yet.

Six mistakes that will make the court recalculate your claim

Skipping a deflation month in the calculation. In the hypothetical example, leaving out June would add UAH 527.56 that the court will not award (Joint Chamber of the CmCC SC, No. 905/21/19; CCC SC, No. 751/4086/24).

Handling a partial month of delay incorrectly. A month in which the delay lasts more than 15 days is counted in full, while a shorter one, like January in the example, is skipped. In case No. 910/13071/19 the Joint Chamber of the CmCC SC expressly departed from the conclusions that no inflation losses are charged for a partial month at all (Nos. 910/5625/18, 924/312/18 and 916/1883/16).

Including the day of actual payment in the delay. As the same chamber explained, it is not part of the period of delay.

Deducting a partial payment from the original debt. It is deducted from the already indexed debt, and the balance is then indexed further (Joint Chamber of the CmCC SC, No. 905/21/19).

Charging the penalty for more than six months although the delay began before 28 August 2025. The wording “for each day of delay” does not set a different period: you need a clause along the lines of “until the obligation is fully performed” (Grand Chamber of the Supreme Court, No. 911/952/22).

Charging 3 % per annum on the penalty amount. Interest is not charged on neustoika (Civil Code, Art. 550(2)).

Limitation period: one year for the penalty, three years for 3 % and inflation losses

The general three-year limitation period applies to 3 % per annum and inflation losses (Civil Code, Art. 257; CmCC SC, No. 916/1640/25). Failure to perform a monetary obligation is a continuing violation, so they are recovered for the last three years before the claim (Grand Chamber of the Supreme Court, No. 127/15672/16-ц). If, however, the limitation period had not expired as of 2 April 2020, it was extended for the period of quarantine and martial law, and the amounts can be recovered without being limited to the last three years before the claim (Grand Chamber of the Supreme Court, No. 903/602/24, para. 155).

For the penalty, the limitation period is one year (Civil Code, Art. 258(2)(1)), and it is counted separately for each day of delay (CmCC SC, No. 902/959/19), while once the limitation period for the principal debt expires, the period for the penalty expires as well (Civil Code, Art. 266). The court applies the limitation period only if a party has raised it before the judgment is delivered (Civil Code, Art. 267(3)).

From 30 January 2024 the limitation period was suspended for the duration of martial law, but Law No. 4434-IX removed this rule (paragraph 19 of the Final and Transitional Provisions of the Civil Code). By the Supreme Court’s count, the limitation period was suspended from 30 January 2024 to 3 September 2025 inclusive and has continued to run since 4 September 2025 (CCC SC, No. 751/4086/24; Civil Code, Art. 263(3)). Read literally, this means that the one-year limitation period for the penalty for the days of the pause began to run on 4 September 2025 and expired in early September 2026. We have not found a Supreme Court conclusion on the penalty specifically, but if the debtor raises the limitation period, it is better not to count on this part of the penalty.

Texts of the laws and Supreme Court rulings, NBU rates and State Statistics Service indices for self-checking

Civil Code, Art. 5, 253, 255, 257, 258, 263, 266, 267, 549–551, 617, 625, paragraph 18 of the Final and Transitional Provisions (version of 5 August 2026) — zakon.rada.gov.ua; Commercial Code, Art. 232 (no longer in force since 28 August 2025) — zakon.rada.gov.ua; laws No. 4196-IX, No. 4434-IX and No. 543/96-ВР

Commercial Procedure Code, Art. 162, 163, 238 — zakon.rada.gov.ua; Law “On Court Fee”, Art. 4 — zakon.rada.gov.ua; Law “On the State Budget of Ukraine for 2026”, Art. 7 — zakon.rada.gov.ua; Presidential Decree No. 596/2026; Resolution No. 14 of the Plenum of the Higher Commercial Court of Ukraine

NBU: archive of discount rate decisions, decision of 17 September 2026; State Statistics Service, consumer price indices: December 2025, August 2026

Grand Chamber of the Supreme Court: No. 903/602/24, No. 910/14524/22, No. 911/952/22, No. 703/2718/16-ц, No. 916/190/18; Joint Chamber of the CmCC SC: No. 905/21/19, No. 910/13071/19, No. 911/2269/22

Commercial Cassation Court: No. 910/14479/23 (910/5871/24), No. 911/437/25, No. 910/16298/24, No. 910/16193/24, No. 916/1640/25, No. 902/959/19, No. 910/8349/22; Civil Cassation Court: No. 751/4086/24, No. 183/7850/22

Do war, a loan agreement or a court judgment stop the accrual of 3 % and the penalty?

The debtor says they had no money because of the war. The court may take the war into account when deciding whether to reduce sanctions, as in case No. 911/437/25. The exception for 3 % and inflation losses is loans and credit.

The counterparty owes money under a loan agreement, not a supply contract. Does anything change?

Yes: during martial law and for 30 days after it ends, a borrower under a credit or loan agreement is released from 3 % per annum, inflation losses and neustoika (paragraph 18 of the Final and Transitional Provisions of the Civil Code), and martial law is still in effect: as of 5 October 2026 it has been extended until 31 October 2026 (Decree No. 596/2026). The CmCC SC applied this paragraph to repayable financial assistance that an individual had provided to a limited liability company (No. 910/8349/22), but it does not extend to supply, services or the return of an advance payment (CCC SC, Nos. 183/7850/22 and 751/4086/24). For a debt between individuals under an IOU there is a separate guide: how to recover money from a debtor.

Will 3 % and the penalty continue to accrue after the court judgment?

The court may state in the judgment that interest or the penalty accrues until the judgment is enforced, and the enforcement officer will calculate the final amount (Commercial Procedure Code, Art. 238(10)). The court cannot order both interest and the penalty at the same time (Grand Chamber of the Supreme Court, No. 910/14524/22, para. 127). If the dispute is decided under the Commercial Code and the contract did not set a different period, further accrual of the penalty is also limited to six months (ibid., para. 143). Further accrual is requested in the claim, and during court representation in the case you make sure the court resolves this issue in the operative part of the judgment. Even if the court did not order it, the judgment does not terminate the monetary obligation: 3 % per annum and inflation losses for the period from the judgment to actual payment can be recovered in a separate claim (Grand Chamber of the Supreme Court, No. 916/190/18).

We will calculate the claim from your contract, acceptance certificates and payment orders

Send us the contract, delivery notes or acceptance certificates, payment orders for partial payments and your correspondence with the debtor. We will calculate the 3 % per annum, inflation losses and the penalty for each period, check whether the six-month cap applies and what the limitation period has already cut off, and tell you where to start: with a letter of claim or straight away with a lawsuit.
