The internet is full of headlines about \u2018one-click divorce via Diya\u2019, but the reality is somewhat different from the advertising slogans.<\/p>\n<p>In this article, we\u2019ll explain\u2014without embellishment or complex legal jargon\u2014how the process of getting a divorce via a smartphone actually works, what restrictions currently exist, and exactly what you\u2019ll need to do to achieve the coveted \u2018single\u2019 status.<\/p>\n<h2>Can you get a full divorce via Diya? The main myth<\/h2>\n<p>Let\u2019s start with the main disappointment faced by hundreds of Ukrainians: it is impossible to <a href=\"https:\/\/svaroglaw.com\/en\/simejne-pravo\/advokat-z-rozluchen\/\">get divorced<\/a> completely without leaving home and simply by pressing a button in the app. Unlike online marriage, which was recently launched on <a href=\"https:\/\/diia.gov.ua\/\">Diya<\/a> as a fully-fledged service\u2014from submitting an application to the wedding ceremony via video link\u2014divorce is a much more complicated matter.<\/p>\n<p>Through the Diia portal, you can only submit an electronic application and pay the state fee. However, the state registration of a divorce is a serious legal procedure. Ukrainian legislation is designed to give people time to reflect and to protect the rights of both parties. Therefore, you will still have to finalise the process offline.<\/p>\n<h3>When \u2018D\u0456\u044f\u2019 can help, and when you\u2019ll still have to go to the Registry Office or court<\/h3>\n<p>\u2018D\u0456\u044f\u2019 acts as a convenient intermediary, sparing you the need to queue twice: first to collect the forms and payment details, and then to hand them in. Instead, you can complete everything from the comfort of your sofa. But this option isn\u2019t available to everyone. The digital format is only available if there are no fundamental disputes or aggravating circumstances. If you have property disputes or children, Diya will automatically redirect you to the traditional court system.<\/p>\n<h2>Conditions for filing for divorce online<\/h2>\n<p>Before you open your laptop, check whether your situation falls under the current rules for online filing. The state clearly divides divorces into two categories.<\/p>\n<h3>Option 1: The couple have no joint minor children and there is mutual consent<\/h3>\n<p>This is the ideal scenario for using \u2018Diya\u2019. If you are both adults, have no children under the age of 18 (or your children are already of legal age), and both husband and wife agree to the divorce \u2014 you can confidently submit your application via the portal. This is known as a divorce by mutual consent through the Civil Registry and Civil Status Acts (DRACS) authorities, where \u2018Diya\u2019 simply automates the first step.<\/p>\n<h3>Option 2: Divorce where there are children or where one partner does not consent<\/h3>\n<p>In this case, digital tools are of no help. The law stipulates that:<\/p>\n<ul>\n<li aria-level=\u20181\u2019>If you have joint minor children, divorce is only possible through the courts. The state must verify who the children will live with, how maintenance will be paid, and whether the child\u2019s rights are being infringed.<\/li>\n<li aria-level=\u20181\u2019>If one spouse is categorically opposed to the divorce, the other will have to file a claim with the court unilaterally.<\/li>\n<\/ul>\n<p>It is not currently possible to file a claim with the court via \u2018Diy\u2019. There is a separate system for this \u2014 \u2018Electronic Court\u2019 \u2014 which requires significantly more legal knowledge and preparation of documents.<\/p>\n<h2>What you\u2019ll need to file a claim: a complete checklist<\/h2>\n<p>To ensure the process of filling in the form isn\u2019t interrupted halfway through due to a missing document, prepare everything in advance. You will need:<\/p>\n<ol>\n<li aria-level=\u20181\u2019>A computer or laptop with internet access. (Important: the application is submitted via the Diya portal in a web browser, not via a mobile app on your phone).<\/li>\n<li aria-level=\u20181\u2019>Diya.Signature or any other QES (qualified electronic signature). Both the husband and wife need one, as both must sign the application. <\/li>\n<li aria-level=\u20181\u2019>Passports for both spouses (details from these or ID cards).<\/li>\n<li aria-level=\u20181\u2019>Marriage certificate (you will need its series, number, date of issue and the exact name of the issuing authority).<\/li>\n<li aria-level=\u20181\u2019>A bank card with sufficient funds to cover the state fee and bank charges.<\/li>\n<\/ol>\n<h2>Step-by-step guide: how to file for divorce via the Diya portal<\/h2>\n<p><img class=\"alignnone wp-image-3180\" src=\u2018https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/06\/gemini_generated_image_zbznq0zbznq0zbzn-1-300x153.jpeg\u2019 alt=\"How to file for divorce via Diya: step-by-step guide\" width=\"971\" height=\"495\" \/><\/p>\n<p>The procedure consists of several logical steps. You will need to provide:<\/p>\n<ul>\n<li aria-level=\u20181\u2019>Your personal and passport details (some of which will be automatically populated from the registers).<\/li>\n<li aria-level=\u20181\u2019>Details of your spouse (full name, date of birth, RNOKPP).<\/li>\n<li aria-level=\u20181\u2019>Details from your marriage certificate (series, number, date of registration).<\/li>\n<li aria-level=\u20181\u2019>Information on which surname you wish to use after the divorce \u2014 whether to keep your current one or revert to your pre-marriage surname.<\/li>\n<\/ul>\n<h3>Step 3: Selecting a Civil Registry Office and appointment time<\/h3>\n<p>The system will ask you to select a Civil Registry Office (<a href=\"https:\/\/centraljust.gov.ua\/m\/teritorialni-viddili-derjavnoi-reestratsii-aktiv-tsivilnogo-stanu-u-misti-kievi\">RAZS<\/a>) that is convenient for you to visit in person. You select the city, the specific office, as well as the date and exact time of your visit. Available slots are usually offered approximately one month from the date of application.<\/p>\n<h3>Step 4: Pay the administrative fee online<\/h3>\n<p>A payment slip for the state fee is generated directly on the portal. You do not need to go to a bank with a paper receipt. The other spouse must follow this link, check all the details entered, confirm their consent and also apply their Diya.Signature.<\/p>\n<p>Please note: If the other spouse does not sign the application within 24 hours of it being created by the first spouse, it will be automatically cancelled and the fee paid will not be refunded.<\/p>\n<h2>What happens after submitting the application via Diya?<\/h2>\n<p>Once both signatures have been applied, the application is automatically forwarded to your chosen Civil Registry Office. Staff will check that it has been completed correctly and that the details match the registers.<\/p>\n<h3>Application processing times: how long will it take?<\/h3>\n<p>Under Ukrainian law (Article 106 of the Family Code of Ukraine), a marriage cannot be dissolved until one month has elapsed from the date of submitting the application. This month is granted to the couple as a \u2018cooling-off period\u2019. Should you change your mind or reach a compromise, the application can be withdrawn. The law does not permit this period to be shortened.<\/p>\n<h3>Mandatory visit to the Civil Registry Office for final confirmation<\/h3>\n<p>On the specified date and time (which you chose in Step 3), both spouses must attend the chosen Civil Registry Office in person. However, if one of the partners is completely unable to attend (for example, if they are in hospital or on a long-term business trip), this issue must be resolved at the application stage \u2014 by obtaining a notarised consent form authorising the divorce in the absence of one of the parties. If, however, a person simply fails to attend without valid reasons, the proceedings are cancelled and the application will have to be resubmitted.<\/p>\n<h2>How much does a divorce via \u2018Diy\u2019 cost in 2026?<\/h2>\n<p>The financial aspect of an online divorce is fairly nominal compared to court costs. You will need to pay:<\/p>\n<ol>\n<li aria-level=\u20181\u2019>State duty for registering the dissolution of marriage. The amount is linked to the non-taxable minimum income threshold and amounts to 0.5 per cent of this sum.<\/li>\n<li aria-level=\u20181\u2019>Portal fees \/ bank commission for processing the electronic payment (usually a few hryvnias).<\/li>\n<\/ol>\n<p>Overall, the procedure will cost significantly less than standard court fees, which, in the case of a divorce through the courts (where there are children or a dispute), amount to a much higher sum.<\/p>\n<h2>Obtaining an electronic divorce certificate in Diia<\/h2>\n<p>In Ukraine, paper divorce certificates are gradually becoming a thing of the past or are being replaced by digital documents. Once the Civil Registry Office has registered the divorce and entered the details into the State Register of Civil Status Acts, the information is automatically updated.<\/p>\n<p>After a short while, an electronic divorce certificate (or a relevant extract) should appear amongst your digital documents in the \u2018Diya\u2019 mobile app. It has the same legal validity as the paper version bearing an official stamp, thanks to a QR code that can be scanned by government bodies, notaries or banks.<\/p>\n<p>If you need a paper copy of the certificate (for example, for travelling abroad or submitting to foreign institutions), you can also order a duplicate via Diya for delivery to your nearest Ukrposhta branch or by courier.<\/p>\n<h2>Frequently Asked Questions (FAQ)<\/h2>\n<h3><span class=\"s1\"><b>What is \u2018Diya\u2019?<\/b><\/span><\/h3>\n<p class=\"p2\">\u2018Diya\u2019 is a government digital platform that enables Ukrainian citizens to access public services online. Via the app or web portal, you can access digital documents, submit applications, obtain certificates and carry out other legally significant actions without visiting government offices.<\/p>\n<h3>What should you do if one of the spouses is abroad?<\/h3>\n<p>This is one of the most common issues today. If the partner abroad has an activated Diya.Signature, they can sign the online application. However, the problem of having to visit the Civil Registry Office in person a month later remains. If the person is physically unable to travel to Ukraine, the Diya option will not work in its pure form. In such cases, the divorce is usually processed either through the Ukrainian consulate in the country of residence, or through a Ukrainian court by engaging a solicitor to represent their interests remotely.<\/p>\n<h3>Can a divorce application submitted via \u2018Diya\u2019 be withdrawn?<\/h3>\n<p>Yes. You can change your mind within the one-month period leading up to the final registration. To do this, both spouses or one of them must contact the Civil Registry Office to which the application was submitted and submit a written application for withdrawal. If you simply fail to appear at the appointed time for registration, the application will also become invalid, but a record of the unprocessed application may remain in your profile.<\/p>\n<h3>Can property be divided via Diya during a divorce?<\/h3>\n<p>No. The Diya portal is not a court or mediation body. The division of jointly acquired property, determining the children\u2019s place of residence and the award of maintenance are separate legal processes. You can resolve these either amicably at a notary\u2019s office (by drawing up a voluntary agreement) or through the courts. A divorce via Diya records only one fact: the termination of the marital relationship between two people who have no claims against one another regarding the very fact of the dissolution of the union.<\/p>\n<h3><span class=\"s1\"><b>Can I file for a divorce via Diya whilst abroad?<\/b><\/span><\/h3>\n<p class=\"p2\">Yes, provided you have access to your account, an electronic signature and meet the service\u2019s terms and conditions.
