A repeat offence within a year will cost UAH 34,000 and three years without a licence. If you have already been penalised twice within a year for drink-driving or refusing the test, the sanction is UAH 51,000, ten years without a licence and confiscation of the car if it is your private property. All these penalties are imposed by a district or city court (CAO, Art. 221), so a police officer does not issue a fine on the spot.

For the vast majority of people stopped while drunk at the wheel, the matter ends with a court ruling. According to the Patrol Police, in 2025 officers drew up 138,047 reports under Parts 1–4 of Article 130, and that year local courts imposed penalties under this article on 108,764 people (State Judicial Administration (SJA) report on Form No. 1-п). In 2025 sentences under Article 286-1 became final in respect of 397 convicted persons, and 193 of them received actual imprisonment (Form No. 6).

Where Article 130 of the CAO ends and Article 286-1 of the Criminal Code begins

The line between an administrative offence report and criminal proceedings is drawn by the consequences of the drive. For a case to proceed under Article 286-1, three circumstances must coincide:

Intoxication at the wheel: the driver was driving while intoxicated by alcohol, drugs or another substance, or under the influence of medicines that impair attention and reaction time.

The driver’s own breach of the rules: it was this driver who broke the rules of road safety or vehicle operation.

Harm caused by that breach: the victim suffered bodily injury of medium severity or grave bodily injury, or died.

If even one of them is missing, there is no criminal liability under Article 286-1. Minor injuries, an accident without victims or a crash caused by another driver keep the intoxicated driver within Article 130 of the CAO, and a first offence is classified under Part 1 regardless of whether the device showed 0.3 ‰ or 2 ‰.

A sober driver at fault in the same kind of crash is tried under Article 286 of the Criminal Code, and the two articles differ most where the consequences are least serious. For medium-severity injury, Part 1 of Article 286 allows a fine of UAH 51,000 to UAH 85,000, correctional labour for up to two years, arrest for up to six months or restriction of liberty for up to three years, whereas Part 1 of Article 286-1 provides only for imprisonment for up to three years. If a person was killed, a sober driver faces 3 to 8 years’ imprisonment (Art. 286(2)), and the court may choose not to impose a driving ban. For an intoxicated driver, Part 3 of Article 286-1 provides for 5 to 10 years and a mandatory driving ban of 5–10 years (the court may decline to impose it only under Article 69(2) of the Criminal Code). Under Article 12 of the Criminal Code, Part 1 of Article 286-1 is a non-grave crime, Parts 2 and 3 are grave crimes, and Part 4, where several people were killed and the term reaches 12 years, is an especially grave crime.

In 2025 intoxicated drivers caused 643 accidents with victims: 73 people were killed and 857 injured. For January–August 2026 the Patrol Police counted 329 such accidents, 25 deaths and 427 injured. For 2025 the Office of the Prosecutor General recorded 1,044 criminal offences under Article 286-1; a notice of suspicion was served in 746 cases and 615 were sent to court. For the eight months of 2026 the figures were 678, 434 and 312 respectively. The prosecution report also covers proceedings from previous years, so it is not worth calculating proportions from it.

Article 130 CAO fines and Article 286-1 Criminal Code sanctions in one table

The amounts are calculated from a tax-free minimum income of UAH 17 (paragraph 5, Subsection 1, Section XX of the Tax Code). The court chooses detention instead of the fine, while the driving ban and, under Part 3, confiscation are imposed with either option. Detention is not applied to pregnant women, women with children under 12, minors or people with Group I and II disabilities (CAO, Art. 32(2)), so for them only the fine remains under Parts 2–4. In 2025, 952 people received detention as the principal penalty under Article 130, and 107,799 a fine.

A repeat offence within a year: when the car is taken away under Parts 2 and 3 of Article 130

A repeat offence within a year is classified under Part 2 of Article 130 if an administrative penalty has already been imposed on the person for the previous one (CAO, Art. 35, point 2), whatever that offence was: driving while intoxicated, handing over the wheel or refusing the test. Part 3 requires more: within the year there must already be two rulings imposing penalties, and specifically for driving while intoxicated or refusing the test. Penalties for handing over the wheel do not count here, and a third report without two previous rulings does not yet mean Part 3. The consequences for the car and the licence are as follows:

Forfeiture for compensation under Part 2 is ordered at the court’s discretion, with either the fine or detention. The car is sold compulsorily, and the former owner receives the proceeds minus the costs of the sale (CAO, Art. 28). In 2025 such forfeiture was ordered 202 times under Article 130.

Confiscation under Part 3 is mandatory whichever principal penalty is chosen, but only for a car that is the offender’s private property: it passes to the state without compensation (Art. 29). There were 595 such decisions in 2025.

Driving bans add up: as a general rule, a driving ban lasts up to 3 years for a gross or repeat offence and up to 10 years for systematic offences, but the unserved part of a previous ban is added to the new one, and together the term may exceed these limits (CAO, Art. 30(2), (3)).

Over 0.2 per mille, a refused test or an accident with a victim: three situations after a stop

The roadside device showed intoxication
<circle cx="12" cy="12" r="9"/>Part 1, Art. 130

Alcohol intoxication is established when the police officer’s device shows more than 0.2 per mille of alcohol in the blood. Before the test, at your request, the officer must show the device’s verification certificate and a certificate of conformity or a declaration of conformity (paragraph 5, Section II). If you agreed with the result, that is enough for a report under Part 1 of Article 130 (paragraph 5 of the Procedure approved by Cabinet of Ministers Resolution No. 1103). If you disagree, say so on camera: the test is then carried out at a healthcare facility from the approved list, no later than two hours after the grounds were established and in the presence of a police officer (CAO, Art. 266(3), (4)). It is not an admission of intoxication: it is a separate offence, so the court does not try to establish how many per mille the device would have shown. Courts also treat repeatedly pretending to blow, after the officer’s warnings, as a refusal (Khmelnytskyi Court of Appeal, No. 679/810/26). Refusing only the Drager, however, is not yet an offence if you agreed to a test at a medical facility: the Odesa Court of Appeal closed the case of a driver who, after agreeing, was never referred to the hospital (No. 509/661/26). Other arguments drivers raise are examined in our article on why refusing to blow into a Drager costs the same UAH 17,000.

Refusing does not save you from a criminal case after an accident with a victim. In case No. 153/134/22 the Criminal Cassation Court of the Supreme Court (CrCC SC) held that the court of appeal’s conclusion that refusing the test confirmed the driver’s intoxication was incompatible with the presumption of innocence, but it quashed the court of appeal’s judgment primarily because the principle of immediacy had been breached. The ruling contains no conclusion that refusing exempts a driver from Article 286-1: intoxication is proved by other evidence, and in that same case an expert examination found 1.0 ‰ alcohol in the driver’s blood. Moreover, after an accident with injured people, testing the driver is mandatory, even if the driver has been taken to hospital (paragraphs 9 and 12 of Procedure No. 1103).

There was an accident and someone was injured
<circle cx="12" cy="12" r="9"/>Art. 286-1 or 286 Criminal Code

If the victim suffered injury of at least medium severity, the article depends on the evidence of intoxication: if it is proved, the proceedings go under Article 286-1 of the Criminal Code; if not, under Article 286. Article 79 of the Criminal Code contains no such prohibition: the court may release a pregnant woman or the mother of a child under seven on probation unless she has been sentenced to more than five years’ imprisonment for a grave or especially grave crime. That is exactly what the Supreme Court did on 28 April 2026 for a woman convicted under Part 1 of Article 286-1 (No. 697/252/25). In 2025, 11 of the 397 people convicted under Article 286-1 were released on probation, compared with 858 of 1,048 sober drivers convicted under Part 2 of Article 286 for the death or grave injury of a victim.

Under Part 1, a fine was imposed more often than imprisonment. The sanction of Part 1 contains no fine, so the court can impose one only under Article 69 of the Criminal Code, which allows it to switch to a milder type of punishment. The more serious the consequences, the larger the share of actual prison terms: 35 of 65 convicted under Part 2, 91 of 102 under Part 3 and all 8 under Part 4. The convicted man had no previous convictions and sincerely repented. The defence challenged the failure to apply Article 69, while the local court had refused to apply Article 75 because of the express prohibition for intoxicated drivers (case No. 191/1444/25).

A year for the ruling, 10 days to appeal, 15 days to pay the fine

A penalty under Article 130 may be imposed within a year of the date of the offence, not the date of the report (CAO, Art. 38(6)); in most cases heard by a court this period is three months. If the year expires before a ruling, the case is closed (Art. 247, point 7); in 2025 cases against 849 people were closed this way. How this year is counted and why “suspending” a case during military service does not extend it is explained in our article on the time limit for imposing a penalty under Article 130 of the CAO. In these cases the court cannot release a person from liability because the offence is minor and limit itself to a verbal reprimand (note to Art. 22).

Closures in such cases are not that rare: in 2025 local courts closed Article 130 cases against 14,481 of 125,259 people, or 11.6%, because there was no event and no elements of an offence. A test carried out in breach of Article 266 of the CAO is invalid (Part 5). The video of the test must be attached to the report (Part 2), and it is the recording that shows whether the procedure was followed. Police bodycam recordings are kept for 30 days unless the head of the police body extends the period (paragraphs 3 and 4, Section VIII of the Instruction approved by MIA Order No. 1026), so request the video in the first few days. The recording, the device documents and the times in the report are where an appeal against an administrative report under Article 130 of the CAO begins.

A local court’s ruling can be appealed within 10 days of being issued, not of the day you received a copy, and a missed deadline can be restored on application. The fine must be paid no later than 15 days from the day the ruling is served or, if it was appealed, from the day you are notified that the appeal was dismissed (Art. 307(1)). If you miss the deadline, the ruling is sent for enforcement: double the fine is recovered, i.e. UAH 34,000 instead of UAH 17,000, plus the costs of recording offences (Art. 308), and the state enforcement officer adds a 10% enforcement fee (Law “On Enforcement Proceedings”, Art. 27). If, after the ban expires, the service centre refuses or demands more than it should, we help with the return of a driving licence after a ban under Article 130 of the CAO.

Where the myth of a “criminal case” for driving alone came from: the first Article 286-1 in July 2020

The myth grew out of the short and confusing history of the first Article 286-1. Law No. 2617-VIII, in force from 1 July 2020, was to add an article with this number to the Criminal Code, but a completely different one: a criminal misdemeanour of driving while intoxicated, handing over control of a vehicle, refusing a medical examination for intoxication, and consuming alcohol or drugs after an accident or after being stopped by the police. The sanction was a fine of 1,000 to 2,000 tax-free minimum incomes with a driving ban of up to three years, and for a repeat offence a fine of up to 3,000 minimums and a driving ban of two to three years; it did not include imprisonment. As early as 17 June 2020 the Verkhovna Rada had adopted Law No. 720-IX, which removed the subparagraph on this article from Law No. 2617-VIII and was to take effect at the same time, but it was only published on 3 July. The legislation database marks its amendments as “not incorporated”, while the Verkhovna Rada Committee, in its clarification of 18 March 2021, considers the old article to have been deleted as of 3 July 2020. This is the Committee’s position, not a rule of law, so the status of that article in the first days of July 2020 is still disputed.

The current Article 286-1, which the Committee called a new one, appeared on 17 March 2021 with Law No. 1231-IX and concerns only accidents with victims. The same law gave courts a year instead of three months to impose a penalty under Article 130 and restated Part 2 of Article 266 of the CAO, under which the test has since been recorded on video.

Witnesses, discounts, military service: what else people ask about Article 130 cases

Will the case be closed if the test was carried out without witnesses?

No, if the test was recorded on video. Since 17 March 2021 the CAO has required the test to be recorded on video, and two witnesses to be called only when recording is impossible (CAO, Art. 266(2); likewise paragraph 4 of Procedure No. 1103). The absence of witnesses becomes an argument only when there is no video either.

Is a report lawful if it was drawn up by someone other than a patrol officer?

Yes: reports under Article 130 may be drawn up by authorised officials of any National Police body, not only the Patrol Police (CAO, Art. 255(1)(1)).

Where will the case be heard if I was stopped in another region, and can it be heard without me?

The case is heard by the court where the offence was committed (CAO, Art. 276(1)). It will be heard without you only if the file contains confirmation that you were notified in good time and you did not ask for the hearing to be adjourned (Art. 268(1)); Article 130 cases are not on the list of those where the person’s presence is mandatory.

Is there a 50% discount if I pay the fine quickly?

No, the discount applies only to offences recorded automatically and to parking (CAO, Art. 300-1), as well as to fines under Articles 210 and 210-1 (Art. 300-3).

If I pay the fine straight away, will the driving ban be shorter?

No, the fine and the driving ban are two separate penalties in the sanction of Part 1 of Article 130, and the ban is counted from the day the ruling becomes final (Art. 317-1(2)).

Will a person with a disability who cannot get around without a car be banned from driving?

Yes: people who use a car because of a disability are not banned from driving, but this exception does not apply if they drove while intoxicated or evaded the test (CAO, Art. 30(4)).

Are military personnel liable under Article 130?

Yes, on general grounds; only administrative detention is not applied to them (CAO, Art. 15). In 2025 military personnel accounted for 11,484 of the 108,764 people on whom courts imposed penalties under Article 130. As of 5 October 2026 there is no law that would suspend the one-year period during military service.

What do I face if a friend drove my car while drunk?

Handing over control of a vehicle to an intoxicated person is punished under the same Part 1 of Article 130 as driving itself. The sanction distinguishes between drivers (UAH 17,000 and a year without a licence) and other persons (UAH 17,000 only), and you do not have to own the car for this: the law speaks of handing over control. Your friend will be separately liable for driving while intoxicated.

How much is the court fee in such a case?

In 2026 it is UAH 665.60, i.e. 0.2 of the subsistence minimum (Law “On Court Fee”, Art. 4(2)(5)). Only a person on whom the court has imposed a penalty pays it; if the proceedings were closed without a penalty, the fee is not charged (CAO, Art. 40-1).

The report has been drawn up: what to do while the bodycam video is kept for 30 days

Photograph the report, your copy of the test record, the Drager printout and the hospital referral, if there was one, and write down what happened when while you still remember. Request the bodycam video before it is erased, and check the date of the offence: the year for the ruling runs from it, and the 10 days to appeal run from the date of the ruling. If you decide to defend yourself, we will take on the appeal against a drink-driving report: we will check the video and the device documents, send advocate’s requests, prepare objections or an appeal, and if someone was injured in the accident, we will also defend you in the criminal proceedings.

Laws, reports and rulings this article relies on

CAO, Art. 15, 22, 28–30, 32, 35, 38, 40-1, 126, 130, 221, 247, 255, 265-1, 266, 268, 276, 294, 300-1, 300-3, 307, 308, 317-1, 321 (as amended on 10 September 2026) — zakon.rada.gov.ua;
