Guardianship is established for a child under the age of 14, whilst custody applies to a child aged between 14 and 18 (Article 243 of the Family Code). The scope of their powers differs: a guardian acts on behalf of the child, whilst a custodian gives consent to the child\u2019s actions.<\/p>\n<p>Guardianship of a child is required when the parents have died, are unknown, have been declared missing or legally incapacitated, have had their parental rights terminated, are serving a prison sentence, or are otherwise unable to raise the child. Most often, grandparents, aunts, uncles and adult siblings become guardians.<\/p>\n<p>The procedure appears to be administrative, but there are plenty of points where it can come to a standstill: refusal by the guardianship authority, conflict between relatives, the court stage, or documents from the occupied territories.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/p>\n<h2>Who can become a guardian<\/h2>\n<p>A guardian must be an adult with full legal capacity \u2014 upon their written application. Preference is given to the child\u2019s relatives, as well as to persons in whose household the child has been living (Article 244 of the Family Code).<\/p>\n<p>A person may not become a guardian if they:<\/p>\n<ul>\n<li aria-level=\"\u20181\u2019\">have been deprived of their parental rights;<\/li>\n<li aria-level=\"\u20181\u2019\">has been declared legally incompetent or of limited legal capacity;<\/li>\n<li aria-level=\"\u201c1\u201d\">abuses alcohol or drugs;<\/li>\n<li aria-level=\"\u20181\u2019\">has no permanent place of residence or regular income;<\/li>\n<li aria-level=\"\u20181\u2019\">is registered with or receiving treatment at a psychoneurological or narcological clinic;<\/li>\n<li aria-level=\"\u20181\u2019\">was an adoptive parent, and the adoption was annulled through her own fault;<\/li>\n<li aria-level=\"\u20181\u2019\">has been convicted of a crime against a person\u2019s life, health or sexual freedom.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The child\u2019s opinion must be taken into account if they are able to express it. From the age of 14, the child\u2019s consent to the appointment of a specific guardian is, in effect, decisive.<\/p>\n<h2>Two ways of establishing guardianship<\/h2>\n<h3>Through the guardianship and custody authority<\/h3>\n<p>This is the main and administrative route. The decision is taken by the guardianship authority at the district administration or city council.<\/p>\n<p>What to submit:<\/p>\n<ul>\n<li aria-level=\"\u20181\u2019\">an application from the prospective guardian;<\/li>\n<li aria-level=\"\u20181\u2019\">passport and tax identification number;<\/li>\n<li aria-level=\"\u201c1\u201d\">document confirming the child\u2019s status (certificate of the parents\u2019 death, court order terminating parental rights, certificate of disappearance);<\/li>\n<li aria-level=\"\u20181\u2019\">the child\u2019s birth certificate;<\/li>\n<li aria-level=\"\u20181\u2019\">medical certificate regarding the applicant\u2019s state of health;<\/li>\n<li aria-level=\"\u201c1\u201d\">proof of income;<\/li>\n<li aria-level=\"\u20181\u2019\">certificate of no criminal record;<\/li>\n<li aria-level=\"\u20181\u2019\">documents relating to accommodation, report on living conditions;<\/li>\n<li aria-level=\"\u20181\u2019\">consent of other adult members of the applicant\u2019s family living with them;<\/li>\n<li aria-level=\"\u20181\u2019\">written consent from the child (if they are aged 10 or over, their opinion must be taken into account).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Processing time \u2014 up to one month from the date of submission of the complete application.<\/p>\n<h3>Through the courts<\/h3>\n<p>Required when:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li aria-level=\"\u20181\u2019\">the guardianship authority has refused \u2014 the decision is appealed in the administrative court;<\/li>\n<li aria-level=\"\u20181\u2019\">several relatives are claiming guardianship of the same child;<\/li>\n<li aria-level=\"\u20181\u2019\">it is necessary to simultaneously terminate the parents\u2019 rights or declare them missing or legally incapacitated;<\/li>\n<li aria-level=\"\u20181\u2019\">the child has in fact been living with you for years, but this has not been legally formalised \u2014 in which case the fact is established for legal purposes;<\/li>\n<li aria-level=\"\u20181\u2019\">documents have been lost or remain in the temporarily occupied territory.<\/li>\n<\/ul>\n<h2>Rights and responsibilities of a guardian<\/h2>\n<p>A guardian does not become a parent \u2014 and this is fundamental:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li aria-level=\"\u20181\u2019\">they represent the child\u2019s interests without a power of attorney, including in court;<\/li>\n<li aria-level=\"\u20181\u2019\">they may only dispose of the child\u2019s property with the permission of the guardianship authority \u2014 it is not permitted to sell the child\u2019s flat without authorisation;<\/li>\n<li aria-level=\"\u20181\u2019\">receives state benefit for an orphan or a child deprived of parental care;<\/li>\n<li aria-level=\"\u20181\u2019\">is obliged to ensure the child\u2019s education, medical care and upbringing;<\/li>\n<li aria-level=\"\u20181\u2019\">is not entitled to the child\u2019s inheritance and does not acquire <a href=\"https:\/\/svaroglaw.com\/en\/simejne-pravo\/advokat-z-alimentiv\/\">maintenance<\/a> rights;<\/li>\n<li aria-level=\"\u20181\u2019\">biological parents are not exempt from paying maintenance \u2014 it is payable for the child\u2019s upkeep, even if the child lives with a guardian.<\/li>\n<\/ul>\n<p>Guardianship ceases automatically when the child reaches the age of 14 (at which point it transitions to care) and 18 (at which point it ceases entirely), as well as upon the child\u2019s adoption or return to their parents.<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/opika-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-3683\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/opika-infografika.svg\" alt=\"\u2018Rights\" \/><\/a><\/p>\n<h2>What goes wrong in practice<\/h2>\n<ul>\n<li aria-level=\"\u20181\u2019\">Rejection on the grounds of living conditions \u2014 the inspection report deems them \u2018unsatisfactory\u2019. This is appealed, often successfully.<\/li>\n<li aria-level=\"\u20181\u2019\">Conflict between relatives \u2014 a grandmother and an aunt both claim guardianship. The court decides, taking into account the child\u2019s attachment and the conclusion of the guardianship authority.<\/li>\n<li aria-level=\"\u20181\u2019\">The parents have not formally been deprived of their rights \u2014 in which case guardianship will not be established until the issue of their status has been resolved. These are two separate proceedings, and they must be pursued sequentially.<\/li>\n<li aria-level=\"\u20181\u2019\">If there are no documents confirming the parents\u2019 death or that they are missing, separate court proceedings are required.<\/li>\n<li aria-level=\"\u20181\u2019\">A child from an occupied territory \u2014 documents are restored through the courts.<\/li>\n<\/ul>\n<h2>When a solicitor is not required<\/h2>\n<p>The parents have died, you are the grandmother, the child lives with you, the documents are in order, and the guardianship authority has no objections.
