The rest of this page is about the other situations \u2014 where there are children, where the other side objects, where one of the spouses is abroad or on military service. A joint application is filed together with an agreement about the children: who they live with, how the other parent takes part in their upbringing, how maintenance is paid. The court checks whether the agreement harms the child\u2019s interests and gives judgment one month after the application is filed (Art. 109(3)). The court fee is 665.60 UAH (0.2 of the subsistence minimum).<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M14.5 3.5 20.5 9.5l-3 3-6-6z\"\/><path d=\"M11 7 4 14l3 3 7-7\"\/><path d=\"M3 21h10\"\/><\/svg><\/span><span><strong>Adversarial proceedings<\/strong> <span class=\"sb-art\">Art. 110 FC<\/span>: there is no agreement. The claim is filed where the respondent is registered, or where the claimant lives if minor children live with them or health or other valid reasons prevent them travelling; by agreement of the spouses the case may be heard where either of them lives (Art. 27, 28 of the Civil Procedure Code). The court fee is 1,331.20 UAH (0.4 of the subsistence minimum).<\/span><\/li><\/ul><\/div>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/rozluchennya-infografika-en.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-5388\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/rozluchennya-infografika-en.svg\" alt=\"Divorce: civil registry or court\" \/><\/a><\/p>\n<h2>The reconciliation period: the main trap<\/h2>\n<div class=\"sb-stat\"><b>up to 6 months<\/b><span>The court may stay the proceedings for a reconciliation period <span class=\"sb-art\">Art. 240(7) CPC<\/span> \u2014 and that is the most common way a divorce is dragged out.<\/span><\/div>\n<p>If the other side objects, they almost always ask the court for time to reconcile. The court may stay the case for up to six months (Art. 240(7) of the Civil Procedure Code), and that is the most common way of dragging things out. The court cannot force anyone to stay married: if one spouse insists on dissolution, the marriage will be dissolved \u2014 it is only a question of when.<\/p>\n<p>What works against delay is evidence that the marriage has in fact ended: living separately (a tenancy agreement, a certificate of registered residence), separate budgets, correspondence, witness testimony, and a consistent position at every hearing.<\/p>\n<blockquote class=\"sb-quote\"><p>With that evidence the court either refuses the reconciliation period or limits it to one or two months instead of six.<\/p><\/blockquote>\n<h2>When the court will not dissolve a marriage<\/h2>\n<div class=\"sb-note sb-note--warn\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3 2 20h20z\"\/><path d=\"M12 10v5M12 17.6v.4\"\/><\/svg><div class=\"sb-note__body\"><p>A claim for divorce cannot be brought during the wife\u2019s pregnancy or within one year of the birth of a child <span class=\"sb-art\">Art. 110(2) FC<\/span>. This applies to both husband and wife. Clients usually learn of this rule at the consultation, and a claim returned because of it costs the court fee and several months of waiting.<\/p><\/div><\/div>\n<p>The exceptions (Art. 110(3)\u2013(5) of the Family Code) are narrow: unlawful conduct by one spouse amounting to a criminal offence against the other or the child, or paternity of the child being recognised by another person.<\/p>\n<h2>Divorce when you are abroad or on military service<\/h2>\n<p>In our cases in 2024\u20132026, one of the parties is often abroad or serving with their unit.<\/p>\n<ul class=\"sb-ilist\"><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h8l4 4v14H6z\"\/><path d=\"M14 3v4h4M9 12h6M9 16h6\"\/><\/svg><\/span><span>The lawyer runs the case without you under a legal services agreement, filing documents through the Electronic Court.<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"9\" cy=\"8\" r=\"3.4\"\/><path d=\"M2.6 20a6.4 6.4 0 0 1 12.8 0\"\/><circle cx=\"17.5\" cy=\"9\" r=\"2.4\"\/><path d=\"M16 14.4A5 5 0 0 1 22 19\"\/><\/svg><\/span><span>You can take part in a hearing by video link <span class=\"sb-art\">Art. 212 CPC<\/span>, including from abroad.<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M5 12l4 4L19 7\"\/><\/svg><\/span><span>If you are abroad and the divorce goes through the civil registry, the application can be certified by a notary or a consul and handed to the other spouse.<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 21s-6-5.5-6-11a6 6 0 0 1 12 0c0 5.5-6 11-6 11z\"\/><path d=\"M10 8l4 4M14 8l-4 4\"\/><\/svg><\/span><span>If the respondent\u2019s whereabouts are unknown (they have left and are out of contact), the claim is filed at their last known address or where their property is located <span class=\"sb-art\">Art. 28 CPC<\/span>.<\/span><\/li><\/ul>\n<h2>What to file together with the divorce and what to file separately<\/h2>\n<p>The \u201clet us divorce first and sort the rest out later\u201d approach sometimes costs a flat.<\/p>\n<ul class=\"sb-ilist\"><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h12v18l-2-1.5L14 21l-2-1.5L10 21l-2-1.5L6 21z\"\/><path d=\"M9 8h6M9 12h6M9 16h4\"\/><\/svg><\/span><span><strong><a href=\"https:\/\/svaroglaw.com\/en\/simejne-pravo\/advokat-z-alimentiv\/\">Maintenance<\/a><\/strong> can be claimed together with the divorce or separately at any time: no limitation period applies.<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h12M6 21h12\"\/><path d=\"M8 3v3l4 5 4-5V3M8 21v-3l4-5 4 5v3\"\/><\/svg><\/span><span><strong><a href=\"https:\/\/svaroglaw.com\/en\/simejne-pravo\/advokat-z-podilu-majna\/\">Division of property<\/a><\/strong> has a deadline: three years from the day you learned your right had been infringed, not from the date of the divorce <span class=\"sb-art\">Art. 72 FC<\/span>.
