If an employer once failed to file its returns, the company\u2019s archive has been lost and the employment record book was filled in with errors, those years simply <strong>do not exist<\/strong> for the calculation. Nobody tells you: the pension is simply smaller, and that is that.<\/p>\n<p>A pensions lawyer is needed exactly here: to prove service that never reached the register, to challenge an understated calculation, and to obtain a recalculation \u2014 including <strong>for the past<\/strong>.<\/p>\n<blockquote class=\"sb-quote\"><p>This is one of the few categories where a court judgment almost commonest problem: service that \u201cis not there\u201d<\/h2>\n<p>Work <strong>before 1 January 2004<\/strong> is evidenced by the employment record book and archive documents, while service after that date is calculated solely from the register of insured persons (Law \u201cOn Compulsory State Pension Insurance\u201d No. 1058-IV). Where there is no record book or the entries are missing, service is proved in the manner set by Cabinet Resolution No. 637 of 12 August 1993, and where documents are lacking the fact of employment is established in court.<\/p>\n<div class=\"sb-note sb-note--info\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"12\" cy=\"12\" r=\"9\"\/><path d=\"M12 11v5M12 8v.4\"\/><\/svg><div class=\"sb-note__body\"><p>A word about contributions. An employer\u2019s failure to pay the unified social contribution is its breach, and courts often side with an employee who actually worked. But for periods after 2004 the practice is uneven, so such service has to be proved with evidence \u2014 the employment contract, orders, payment records \u2014 and not simply by pointing to someone else\u2019s fault.<\/p><\/div><\/div>\n<h2>Where to start on your own<\/h2>\n<p>Before arguing, you need to see the same data the Pension Fund is working from.<\/p>\n<div class=\"sb-cards sb-cards--2\"><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"11\" cy=\"11\" r=\"7\"\/><path d=\"M20 20l-4-4\"\/><\/svg><\/span><h3 class=\"sb-card__title\">The extract from the register of insured persons<\/h3><div class=\"sb-card__body\"><p> The electronic cabinet at portal.pfu.gov.ua gives individual data on the insured person \u2014 forms OK-5 and OK-7. They show month by month: who filed returns for you and for which periods, on what earnings contributions were paid, and where the gaps are. The same document can be obtained at a Pension Fund service centre on a written request.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><rect x=\"4\" y=\"3\" width=\"16\" height=\"18\" rx=\"2\"\/><path d=\"M8 7h8M8 12h.01M12 12h.01M16 12h.01M8 16h.01M12 16h.01M16 16h.01\"\/><\/svg><\/span><h3 class=\"sb-card__title\">The calculation of the pension awarded<\/h3><div class=\"sb-card__body\"><p> You are entitled to know which periods and sums it was based on. The error is often visible from this document alone: a year missing, the wrong earnings period taken, a preferential coefficient not applied.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h8l4 4v14H6z\"\/><path d=\"M14 3v4h4M9 12h6M9 16h6\"\/><\/svg><\/span><h3 class=\"sb-card__title\">A written refusal<\/h3><div class=\"sb-card__body\"><p> An oral \u201cyou are not entitled\u201d cannot be challenged. Insist on a decision or a reply with reasons \u2014 that document is what the dispute is about.<\/p><\/div><\/article><\/div>\n<h2>Challenging a Pension Fund refusal<\/h2>\n<p>The Fund\u2019s decisions and inaction are challenged in the <strong>administrative court<\/strong> (Art. 19 of the Code of Administrative Procedure). The claim is filed where the claimant lives, so there is no need to travel to a regional centre.<\/p>\n<p><strong>The steps:<\/strong><\/p>\n<ol class=\"sb-steps\"><li><strong>Obtain the written refusal<\/strong> with reasons.<\/li><li><strong>Obtain the pension calculation<\/strong> and the extract from the register of insured persons.<\/li><li><strong>Gather the evidence<\/strong> \u2014 archive certificates, orders, payroll records, witness evidence.<\/li><li><strong>File the administrative claim<\/strong> seeking to have the disputed periods counted and the pension recalculated.<\/li><li><strong>See the judgment enforced<\/strong> \u2014 including the back payment.<\/li><\/ol>\n<p>The <strong>court fee<\/strong> for a non-monetary administrative claim by an individual in 2026 is <strong>1,331.20 UAH<\/strong>, and 20 % less through the Electronic Court. Some claimants are exempt: among others, people with group I and II disabilities, combat veterans and Chornobyl clean-up workers (Art. 5 of the Law \u201cOn Court Fees\u201d). If you win, the fee and the legal costs are recovered from the Pension Fund.<\/p>\n<h2>Payment for the past<\/h2>\n<p>How far back you are paid depends on why the recalculation is being made.<\/p>\n<div class=\"sb-ways\"><div class=\"sb-way sb-way--up\"><span class=\"sb-way__tag\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 19V5M6 11l6-6 6 6\"\/><\/svg>The Fund\u2019s error<\/span><div class=\"sb-way__body\"><p>Where the pension was understated <strong>because of the Pension Fund\u2019s own error<\/strong>, the sums lost through its fault are paid for the past without any time limit (Art. 46 of Law No. 1058-IV). These are the cases that produce substantial back payments.<\/p><\/div><\/div><div class=\"sb-way sb-way--down\"><span class=\"sb-way__tag\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 5v14M6 13l6 6 6-6\"\/><\/svg>Recalculation on application<\/span><div class=\"sb-way__body\"><p>Where it is a <strong>recalculation on your own application<\/strong> \u2014 after continuing to work, for example \u2014 it takes effect from the month following the month you applied with all the documents (Art. 45). So delay in applying costs real money: nobody pays for the earlier months.<\/p><\/div><\/div><\/div>\n<p>Even a small monthly difference over several years exceeds the cost of litigation, and at the consultation we do that arithmetic for your case straight away.<\/p>\n<div class=\"sb-case\"><div class=\"sb-case__head\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3l8 3v6c0 5-3.5 8-8 9-4.5-1-8-4-8-9V6z\"\/><path d=\"M9 12l2 2 4-4\"\/><\/svg><\/span><h2 class=\"sb-case__title\">A case from our practice<\/h2><\/div><p>In 2024 a woman born in 1963 came to us: the Pension Fund had not counted six years at a company liquidated in the late 1990s \u2014 its archive was never handed to a successor, and in her record book the company name did not match the stamp. We sent lawyer\u2019s enquiries to the regional state archive and to the industry association\u2019s archive and found the hiring and dismissal orders and payroll records for four of the six years. The rest of the period was confirmed by two former colleagues and a union card. The administrative court ordered the Fund to count the disputed periods and recalculate: the monthly pension rose by about 900 UAH and the back payment came to around 30,000 UAH. The case took eight months and our fee was 18,000 UAH. (details changed)<\/p><\/div>\n<h2>What the court checks in a pension dispute<\/h2>\n<div class=\"sb-cards sb-cards--2\"><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h8l4 4v14H6z\"\/><path d=\"M14 3v4h4M9 12h6M9 16h6\"\/><\/svg><\/span><h3 class=\"sb-card__title\">Whether the procedure at the Fund was followed<\/h3><div class=\"sb-card__body\"><p> Whether you applied, what documents you filed, whether the Fund gave a written answer with reasons.
