If an employer failed to submit reports at some point, the company\u2019s records have been lost, or your employment record book contains errors \u2014 those years simply <strong>do not exist<\/strong> for the purposes of the calculation. And no one will tell you this: your pension will simply be calculated at a lower rate.<\/p>\n<p>This is precisely where a pension lawyer is needed: to prove service that did not make it into the register, to challenge the underestimated calculation and to secure a recalculation \u2014 including <strong>for the past period<\/strong>.<\/p>\n<p>This is one of the few areas where a court ruling almost always translates into real money: not only an increased pension for the future, but also back pay for previous months.<\/p>\n<p><strong><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/strong><\/p>\n<h2>What we specialise in<\/h2>\n<ul>\n<li><strong>refusal to grant a pension<\/strong> \u2014 on grounds of age, length of service, disability, or the loss of a breadwinner;<\/li>\n<li><strong>unrecognised insurance record<\/strong> \u2014 lost records, errors in the employment record book, employer failed to submit reports;<\/li>\n<li><strong>underestimated pension amount<\/strong> \u2014 incorrectly calculated earnings, coefficients, periods;<\/li>\n<li><strong>pension recalculation<\/strong> \u2014 following continued employment, changes in legislation, or becoming eligible for benefits;<\/li>\n<li><strong>preferential pension<\/strong> \u2014 under Lists No. 1 and No. 2 (hazardous working conditions);<\/li>\n<li><strong><a href=\"https:\/\/svaroglaw.com\/en\/military-lawyer\/pererahunok-vijskovoyi-pensiyi\/\">recalculation of military pension<\/a><\/strong>;<\/li>\n<li><strong>payment of pension for a past period<\/strong> \u2014 where entitlement existed but the pension was not paid;<\/li>\n<li><strong>pensions for internally displaced persons<\/strong> and those who have moved abroad.<\/li>\n<\/ul>\n<h2><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/pensiya-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-4048\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/pensiya-infografika.svg\" alt=\"Pension lawyer\" \/><\/a><\/h2>\n<h2>The most common problem: \u2018missing\u2019 length of service<\/h2>\n<p>Until 2004, there was no personalised record-keeping system \u2014 length of service was confirmed by <strong>an employment record book<\/strong>. And this is where the problems begin:<\/p>\n<ul>\n<li><strong>errors in the records<\/strong> \u2014 incorrect dates, missing stamps, the company name does not match the order;<\/li>\n<li><strong>the company has been wound up<\/strong>, but the archives have not been transferred;<\/li>\n<li><strong>the archives have been lost<\/strong> \u2014 destroyed, burnt, or left behind in occupied territory;<\/li>\n<li><strong>the employer did not pay contributions<\/strong> \u2014 even though you were officially employed;<\/li>\n<li><strong>work abroad<\/strong> \u2014 requires separate confirmation.<\/li>\n<\/ul>\n<p><strong>What we do:<\/strong> legal requests to archives, the Pension Fund of Ukraine (PFU) and the legal successors of companies; gathering circumstantial evidence \u2014 orders, salary records, party or trade union documents, and testimony from colleagues. If there are no documents at all, the fact of employment <strong>is established in court<\/strong>.<\/p>\n<p>Important: the employer\u2019s failure to pay contributions <strong>is not grounds<\/strong> for not counting your length of service if you actually worked. This is their breach, not yours.<\/p>\n<h2>Appealing against a refusal by the Pension Fund<\/h2>\n<p>Decisions and omissions by the Pension Fund may be appealed in <strong>an administrative court<\/strong>.<\/p>\n<p><strong>Procedure:<\/strong><\/p>\n<ol>\n<li><strong>Obtain a written refusal<\/strong> stating the grounds. A verbal statement such as \u2018you are not entitled\u2019 cannot be appealed \u2014 demand a written document.<\/li>\n<li><strong>Obtain a pension calculation<\/strong> \u2014 you have the right to know the periods and amounts on which it is based. Very often, an error is already apparent at this stage.<\/li>\n<li><strong>Gather evidence<\/strong> \u2014 archive records, documents, witness statements.<\/li>\n<li><strong>File an administrative claim.<\/strong><\/li>\n<li><strong>Secure a recalculation<\/strong> \u2014 including back payments for the previous period.<\/li>\n<\/ol>\n<p><strong>Court fees<\/strong> for a non-pecuniary administrative claim brought by an individual \u2014 <strong>1,331.20 UAH<\/strong> (2026). If the claim is successful, these are recovered from the Pension Fund of Ukraine along with legal fees.<\/p>\n<h2>Payment for the past period<\/h2>\n<p>This is something the Pension Fund does not mention.<\/p>\n<p>If the court finds that the pension has been calculated incorrectly, the recalculation is made <strong>not from the date of the court\u2019s decision<\/strong>, but from the moment your entitlement arose. In other words, back payments are made <strong>for the past period<\/strong>.<\/p>\n<p>In practice, these amounts often exceed legal costs many times over.
