The penalty has two forms, and drivers often learn of the second only in the courtroom: a fine of 20\u201325 tax-free minimums (340\u2013425 UAH) <strong>or a driving ban of six months to a year<\/strong>.<\/p>\n<p>But even a year without a licence is rarely the most expensive part. An Art. 124 decision formally records <strong>your fault in the accident<\/strong>, and every money claim that follows is built on it:<\/p>\n<div class=\"sb-dark\"><ul class=\"sb-rlist\"><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M5 16l1.6-6h10.8L19 16\"\/><path d=\"M3 16h18v3H3z\"\/><circle cx=\"7\" cy=\"19.5\" r=\"1.4\"\/><circle cx=\"17\" cy=\"19.5\" r=\"1.4\"\/><\/svg><span>your motor insurer pays the other party but pays you nothing for your own car, because you are the one at fault;<\/span><\/li><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M3 9l9-5 9 5\"\/><path d=\"M4 9h16v2H4z\"\/><path d=\"M6 11v6M10 11v6M14 11v6M18 11v6\"\/><path d=\"M3 20h18\"\/><\/svg><span>where there are grounds for recourse (intoxication, leaving the scene, no licence), the insurer pays the victim and then <strong>recovers the money from you<\/strong>;<\/span><\/li><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M14.5 3.5 20.5 9.5l-3 3-6-6z\"\/><path d=\"M11 7 4 14l3 3 7-7\"\/><path d=\"M3 21h10\"\/><\/svg><span>everything above the insurer\u2019s cap the victim recovers from you by <strong>civil claim<\/strong>: repairs, diminished value, <a href=\"https:\/\/svaroglaw.com\/en\/czyvilnyj-advokat\/vidshkoduvannya-moralnoyi-ta-materialnoyi-shkody\/\">non-pecuniary damage<\/a>;<\/span><\/li><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M3 5l6 6 4-4 8 8\"\/><path d=\"M15 15h6V9\"\/><\/svg><span>your comprehensive and compulsory premiums may rise next year.<\/span><\/li><\/ul><\/div><blockquote class=\"sb-quote\"><p>A 425 UAH fine against a 180,000 UAH claim from the other driver: a difference of roughly 420 times. That is why a lawyer is needed while the charge is still being heard, before the decision comes into force and becomes evidence in the civil case.<\/p><\/blockquote><div class=\"sb-call\"><a class=\"sb-call__link\" href=\"tel:+380955545424\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M5 4h4l2 5-2.5 1.5a11 11 0 0 0 5 5L15 13l5 2v4a2 2 0 0 1-2 2A16 16 0 0 1 3 6a2 2 0 0 1 2-2z\"\/><\/svg><span>+38 095 554-54-24<\/span><\/a><span class=\"sb-call__note\">legal consultation<\/span><\/div>\n<h2>Three months to impose a penalty: the difference from Art. 130<\/h2>\n<div class=\"sb-stat\"><b>3 months<\/b><span><strong>The period for imposing a penalty under Art. 124<\/strong> runs from the day of the offence (Art. 38(2)). The case is heard by a court, and if no decision is made within that period the <strong>proceedings are closed<\/strong> and the driver is treated as never having been charged.<\/span><\/div>\n<p>Under <a href=\"https:\/\/svaroglaw.com\/en\/advokat-po-dtp\/oskarzhennya-administratyvnogo-protokolu-za-st-130-kupap-st-124\/\">Art. 130<\/a> (driving while intoxicated) the period is one year (Art. 38(7)), so advice from forums works quite differently for the two articles. Courts hear Art. 124 cases slowly, and lawful applications within those three months \u2014 for the video, for the other driver to be called, for a vehicle expert report \u2014 often lead to closure.<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/st-124-kupap-infografika-1-en.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-5368\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/st-124-kupap-infografika-1-en.svg\" alt=\"Lawyer for Article 124 cases\" \/><\/a><\/p>\n<h2>How Art. 124 cases are won<\/h2>\n<div class=\"sb-cards sb-cards--2\"><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3v18\"\/><path d=\"M3 8h5v8H3zM16 8h5v8h-5z\"\/><\/svg><\/span><h3 class=\"sb-card__title\">There was a breach, but it did not cause the accident<\/h3><div class=\"sb-card__body\"><p> The breach must be the <strong>cause<\/strong> of the collision. A driver may have been 10 km\/h over the limit, but if the other party pulled out from a minor road 15 metres in front of them, that is the cause and there is no Art. 124 offence.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 4v17M5 21h14\"\/><path d=\"M12 7 5 9M12 7l7 2\"\/><path d=\"M5 9 2.5 15h5zM19 11l-2.5 6h5z\"\/><\/svg><\/span><h3 class=\"sb-card__title\">Shared fault<\/h3><div class=\"sb-card__body\"><p> Both drivers often breach the rules, and the court may issue a decision against each. Compensation is then reduced in proportion: a 180,000 UAH claim becomes 90,000 UAH on equal fault.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h8l4 4v14H6z\"\/><path d=\"M14 3v4h4M9 12h6M9 16h6\"\/><\/svg><\/span><h3 class=\"sb-card__title\">The accident plan is wrong<\/h3><div class=\"sb-card__body\"><p> People sign it \u201cto get away sooner\u201d, and the expert then calculates the trajectories from it. Comments on the plan must be made at the scene; if it was signed as it stands, it is rebutted by video and witnesses.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M5 16l1.6-6h10.8L19 16\"\/><path d=\"M3 16h18v3H3z\"\/><circle cx=\"7\" cy=\"19.5\" r=\"1.4\"\/><circle cx=\"17\" cy=\"19.5\" r=\"1.4\"\/><\/svg><\/span><h3 class=\"sb-card__title\">No technical possibility of avoiding the crash<\/h3><div class=\"sb-card__body\"><p> Where the collision could not have been avoided (the other driver pulled out suddenly, a pedestrian ran out from behind an obstacle), there is no fault even on a formal breach. This is established by a vehicle expert report.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 21s-6-5.5-6-11a6 6 0 0 1 12 0c0 5.5-6 11-6 11z\"\/><path d=\"M10 8l4 4M14 8l-4 4\"\/><\/svg><\/span><h3 class=\"sb-card__title\">The state of the road<\/h3><div class=\"sb-card__body\"><p> A pothole, missing signs or an unwarned slippery surface are the road authority\u2019s responsibility. Such cases are won where the scene was recorded: photographs of the pothole with landmarks, the police called, an entry in the report.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><rect x=\"3\" y=\"7\" width=\"18\" height=\"13\" rx=\"2\"\/><path d=\"M9 7V5a2 2 0 0 1 2-2h2a2 2 0 0 1 2 2v2\"\/><path d=\"M3 12h18\"\/><\/svg><\/span><h3 class=\"sb-card__title\">A defect you did not know about<\/h3><div class=\"sb-card__body\"><p> And could not have known about, shifts responsibility onto the garage that serviced the car.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3 2 20h20z\"\/><path d=\"M12 10v5M12 17.6v.4\"\/><\/svg><\/span><h3 class=\"sb-card__title\">Procedural breaches<\/h3><div class=\"sb-card__body\"><p> A defective charge sheet, rights not explained, no copy served.<\/p><\/div><\/article><\/div>\n<h2>What to do after an accident with no injuries<\/h2>\n<ol class=\"sb-steps\"><li><strong>Do not leave the scene.<\/strong> That is a separate offence (Art. 122-4) and a ground for the insurer\u2019s recourse.<\/li><li><strong>Record the scene before the cars are moved:<\/strong> photographs, skid marks, debris, signs and markings.<\/li><li><strong>Do not sign the plan<\/strong> if you disagree with it, or sign it <strong>with comments<\/strong>.<\/li><li><strong>Find witnesses<\/strong> and take their details at once.<\/li><li><strong>Save the recordings<\/strong> from your dashcam and nearby cameras: they are overwritten within 3\u20137 days.<\/li><li><strong>Do not admit fault at the scene.<\/strong> An emotional \u201csorry, it was me\u201d ends up in the statement.<\/li><li><strong>Take advice<\/strong> before the first hearing.<\/li><\/ol>\n<h2>The European accident statement: when it hurts<\/h2>\n<p>The European statement is completed without the police where there are no injuries, both drivers agree on who was at fault, and the loss is within the insurer\u2019s limit.<\/p>\n<p><strong>Do not complete it<\/strong> if:<\/p>\n<div class=\"sb-panel sb-panel--dark\">\n\t\t\t<div class=\"sb-panel__head\">\n\t\t\t\t<span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" 10v5M12 17.6v.4\"\/><\/svg><div class=\"sb-note__body\"><p>A signed European statement is a written admission of fault, and far harder to challenge than a court decision.<\/p><\/div><\/div>\n<h2>What the court checks in an Art. 124 case<\/h2>\n<p>The court checks whether the driver\u2019s conduct breached a specific rule of the road, whether there is a causal link between that breach and the damage, and whether the charge sheet complies with Arts. 254\u2013256. If the sheet says only \u201clost control\u201d with no rule cited, that is a ground to close the case.<\/p>\n<p>Applications to call the other driver and to obtain the police body-camera footage are made by us: the court does not do it of its own motion.<\/p>\n<div class=\"sb-case\"><div class=\"sb-case__head\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3l8 3v6c0 5-3.5 8-8 9-4.5-1-8-4-8-9V6z\"\/><path d=\"M9 12l2 2 4-4\"\/><\/svg><\/span><h2 class=\"sb-case__title\">A case from our practice<\/h2><\/div><p>In 2025 a driver from Kyiv\u2019s Darnytsia district came to us after a collision at a roundabout: the police had charged him under Art. 124, he had signed the plan without comment, and the other car\u2019s owner had already sent a claim for 214,000 UAH of repairs. We obtained, through the court, footage from a camera on a nearby building showing that the other driver had entered the roundabout without giving way. The proceedings against our client were closed for want of an offence two weeks before the three-month period expired; the other party withdrew the claim, and their insurer paid for the repairs to our client\u2019s car.
