A week later, it is one person\u2019s word against that of a police officer \u2014 and the court has nothing to go on.<\/p>\n<p>Challenging police actions is only effective when there is <strong>evidence<\/strong>: a medical report on bodily injuries, notes in the report, video footage, witnesses, and written complaints submitted <strong>immediately<\/strong>.<\/p>\n<p>That is why the first thing we tell our clients is: document everything immediately \u2014 even if it seems that \u2018you won\u2019t be able to prove anything anyway\u2019.<\/p>\n<p><strong><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/strong><\/p>\n<h2>What can be appealed against<\/h2>\n<p><strong>Actions and decisions of the investigator or prosecutor<\/strong> \u2014 to the investigating judge (Article 303 of the Code of Criminal Procedure):<\/p>\n<ul>\n<li><strong>failure to enter information into the Unified Register of Pre-trial Investigations<\/strong> \u2014 the statement was not registered;<\/li>\n<li><strong>inaction<\/strong> \u2014 failure to carry out actions which the investigator is obliged to carry out;<\/li>\n<li><strong>closure of criminal proceedings<\/strong>;<\/li>\n<li><strong>refusal to grant motions<\/strong>;<\/li>\n<li><strong>detention<\/strong> \u2014 its lawfulness is reviewed by the investigating judge;<\/li>\n<li><strong>seizure of property<\/strong>, a preventive measure.<\/li>\n<\/ul>\n<p><strong>Actions by police officers that constitute a criminal offence<\/strong> \u2014 a complaint to <strong>the State Bureau of Investigations<\/strong>:<\/p>\n<ul>\n<li><strong>abuse of power or official authority<\/strong> (Article 365 of the Criminal Code) \u2014 in particular involving the use of violence;<\/li>\n<li><strong>torture<\/strong> (Article 127 of the Criminal Code);<\/li>\n<li><strong>negligence in the performance of official duties<\/strong>, abuse of power;<\/li>\n<li><strong>unlawful arrest<\/strong> or detention.<\/li>\n<\/ul>\n<p><strong>Violations in administrative proceedings<\/strong> \u2014 in an administrative court or via a complaint to the management of the authority and to the internal security service.<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/oskarzhennya-policziyi-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-3989\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/oskarzhennya-policziyi-infografika.svg\" alt=\"Appealing against unlawful actions by law enforcement officers\" \/><\/a><\/p>\n<h2>What to do right now<\/h2>\n<p>This is the most important part. Without it, all further steps are pointless.<\/p>\n<ol>\n<li><strong>Medical examination \u2014 immediately.<\/strong> If force was used, see a doctor or call an ambulance <strong>on the very same day<\/strong>. A medical report documenting your injuries is the key piece of evidence. After a few days, the bruises will fade, and with them, the case.<\/li>\n<li><strong>Comments in the report.<\/strong> Do not sign a document that does not reflect the truth. Your recording is evidence.<\/li>\n<li><strong>Written complaints.<\/strong> Verbal complaints do not count. Submit your complaint in writing, ensuring the submission is recorded.<\/li>\n<li><strong>Request copies of all documents<\/strong> that are handed to you or presented for your signature.<\/li>\n<\/ol>\n<h2>Complaint to the investigating judge: how it works<\/h2>\n<p>This is the primary and most effective mechanism.<\/p>\n<ul>\n<li>the complaint is lodged with <strong>the local court<\/strong> where the pre-trial investigation is taking place;<\/li>\n<li><strong>the time limit<\/strong> is within the period specified by law from the moment you became aware of the decision, action or inaction;<\/li>\n<li><strong>there is no court fee<\/strong> for such complaints;<\/li>\n<li>depending on the outcome, the court may <strong>order<\/strong> the investigating judge to take action, <strong>set aside<\/strong> their decision, or <strong>declare the inaction unlawful<\/strong>.<\/li>\n<\/ul>\n<p>This is not a \u2018formality\u2019: a ruling by the investigating judge is binding, and cases usually proceed again following it.<\/p>\n<h2>Compensation for damages<\/h2>\n<p>If the actions were unlawful, damages are payable by <strong>the state<\/strong> \u2014 regardless of the fault of the specific official.<\/p>\n<p>Grounds: an acquittal, the closure of proceedings on grounds of rehabilitation, or a ruling that the detention or arrest was unlawful.<\/p>\n<p>Compensation is payable for: lost earnings, property seized and not returned, fines paid, legal costs, <strong>non-pecuniary damage<\/strong>.<\/p>\n<p>Further details: <a href=\"https:\/\/svaroglaw.com\/en\/kryminalne-pravo\/kompensacziya-shkody-zavdanoyi-organamy-vlady\/\">Compensation for damage caused by public authorities<\/a>.<\/p>\n<h2>A frank assessment of your chances<\/h2>\n<p>These cases are complex.
