The absence of disciplinary measures does not in itself prove rehabilitation. The court assesses the overall picture: attitude towards work and education, participation in programmes, attitude towards the offence committed, compensation for damages to the victim, the availability of accommodation and employment following release, and family support.<\/p>\n<p>A solicitor is needed here not for \u2018backroom deals\u2019, but to gather evidence of rehabilitation and prepare the case materials so that the court has a sound basis on which to make its decision.<\/p>\n<p><strong><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/strong><\/p>\n<h2>How long must be served<\/h2>\n<p>The minimum portion of the sentence depends on the severity of the offence (Article 81 of the Criminal Code):<\/p>\n<table>\n<tbody>\n<tr>\n<th>Category<\/th>\n<th>Must serve<\/th>\n<\/tr>\n<tr>\n<td>A minor or moderately serious offence; a serious offence committed through negligence<\/td>\n<td><strong>at least 1\/2<\/strong> of the sentence<\/td>\n<\/tr>\n<tr>\n<td>Intentional serious offence; a serious offence committed through negligence; repeat offence following a previous sentence<\/td>\n<td><strong>not less than 2\/3<\/strong> of the sentence<\/td>\n<\/tr>\n<tr>\n<td>Intentional particularly serious offence; commission of a new intentional offence following a sentence<\/td>\n<td><strong>not less than 3\/4<\/strong> of the sentence<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Serving the minimum term is merely <strong>the right to apply<\/strong>, not a guarantee of release. The court may refuse even after 3\/4 of the sentence has been served if rehabilitation has not been demonstrated.<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/udz-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-3952\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/udz-infografika.svg\" alt=\"Conditional early release: how much of the sentence must be served (1\/2, 2\/3, 3\/4) and what constitutes proof of rehabilitation\" \/><\/a><\/p>\n<h2>Replacement of the unserved portion of the sentence with a more lenient punishment<\/h2>\n<p>This option is often overlooked, yet it applies in cases where conditional early release is not yet possible.<\/p>\n<p>Under Article 82 of the Criminal Code, the court may replace the unserved portion of the sentence <strong>with a more lenient one<\/strong> \u2014 and this can be done <strong>before<\/strong> the prisoner becomes eligible for conditional early release. This is often an intermediate step: first the replacement, then release.<\/p>\n<p>If the court has refused early release, it is worth considering this particular route \u2014 it is less \u2018stringent\u2019 for the court and is therefore more likely to be granted.<\/p>\n<h2>What proves rehabilitation<\/h2>\n<p>The court makes its decision based on the evidence, not on impressions. Here\u2019s how it works:<\/p>\n<ul>\n<li><strong>a character reference from the administration<\/strong> of the penal institution \u2014 a key document, the content of which can and should be improved in advance;<\/li>\n<li><strong>the absence of current disciplinary sanctions<\/strong> and the presence of <strong>incentives<\/strong>;<\/li>\n<li><strong>a conscientious attitude to work<\/strong> \u2014 employment references, performance indicators;<\/li>\n<li><strong>training, participation in<\/strong> social and educational programmes;<\/li>\n<li><strong>compensation for damages to the victim<\/strong> \u2014 one of the strongest arguments. Partial compensation also matters;<\/li>\n<li><strong>the victim\u2019s position<\/strong> \u2014 their opinion is taken into account;<\/li>\n<li><strong>guarantees following release<\/strong> \u2014 proof of residence, a letter of guarantee from an employer, family support;<\/li>\n<li><strong>state of health<\/strong>, presence of dependants.<\/li>\n<\/ul>\n<p>The most common reason for refusal is <strong>the formal documentation<\/strong>: a \u2018neutral\u2019 character reference, no compensation, no guarantees of employment, and the court sees no evidence to confirm rehabilitation.<\/p>\n<h2>Procedure<\/h2>\n<ol>\n<li><strong>Calculating the time limit<\/strong> \u2014 when the right to apply arises. A mistake here costs you extra months.<\/li>\n<li><strong>Preparing the documents<\/strong> \u2014 in advance, not just a week before submission.<\/li>\n<li><strong>Submission<\/strong> \u2014 the institution\u2019s administration forwards the documents to the court; the prisoner and their lawyer also have the right to apply.<\/li>\n<li><strong>Court hearing<\/strong> \u2014 at the court in the place where the sentence is being served, with the participation of a representative of the institution and the prosecutor.<\/li>\n<li><strong>Court ruling<\/strong> \u2014 granting or refusing release.<\/li>\n<li><strong>Appeal<\/strong> \u2014 in the event of a refusal.<\/li>\n<\/ol>\n<p><strong>Important:<\/strong> in the event of a refusal, a second application may be made <strong>no earlier than one year later<\/strong>. Therefore, submitting an application \u2018on spec\u2019 just to try is a bad idea: a failed attempt costs you a year.<\/p>\n<h2>What a solicitor does<\/h2>\n<ul>\n<li><strong>calculates the time limit<\/strong> and determines when to submit the application;<\/li>\n<li><strong>works on the case materials in advance<\/strong> \u2014 so that character references and documents are ready by the time the right arises;<\/li>\n<li><strong>arranges compensation<\/strong> for the victim and documents it;<\/li>\n<li><strong>secures guarantees<\/strong> \u2014 accommodation, employment, family support;<\/li>\n<li><strong>represents the client in court<\/strong> \u2014 where the prosecutor often objects to release;<\/li>\n<li><strong>appeals against a refusal<\/strong> in the court of appeal.<\/li>\n<\/ul>\n<h2>When not to apply<\/h2>\n<p>Let\u2019s be clear: if there are <strong>outstanding penalties<\/strong>, a negative character reference, the damages have not been compensated and there are no guarantees following release \u2014 the application is almost certain to be refused. And a refusal blocks a repeat application <strong>for a year<\/strong>.<\/p>\n<p>In such a situation, the right strategy is not to apply, but to <strong>prepare<\/strong>: have the penalties lifted, work, compensate for the damage, and gather documents.
