A criminal case begins with the fact that a report has been filed<\/strong>. Details of a criminal offence must be entered in the Unified Register of Pre-Trial Investigations within 24 hours<\/strong> of the report being filed (Art. 214(1) CPC), and the law requires no decision by the investigator about whether it is \u201cworth it\u201d.<\/p>\n

An investigator has no right<\/strong> to refuse to enter the details after \u201cassessing the prospects\u201d or deciding that \u201cthere is no offence here\u201d. Assessment belongs to the investigation, and it comes after<\/strong> registration, not instead of it.<\/p>\n

In practice the complainant hears something else: \u201cwrite it differently\u201d, \u201cthis is a civil dispute\u201d, \u201cwe will check and let you know\u201d. Getting the details into the register takes effort.<\/p>\n

How to file the report properly<\/h2>\n
  1. In writing.<\/strong> Oral reports \u201cgo missing\u201d. Prepare the report in two copies.<\/li>
  2. With proof of filing<\/strong> \u2014 an acknowledgement stamp on your copy, or postal despatch with an inventory of the contents and confirmation of delivery.<\/li>
  3. With a receipt slip<\/strong> \u2014 when you file at a police station they are obliged to issue one. That is your proof of having applied.<\/li>
  4. With specifics<\/strong> \u2014 what happened, when, where, who was involved, what evidence exists. A vague report gives the investigation a reason to play for time.<\/li>
  5. Citing the article<\/strong> \u2014 not compulsory, but useful: it makes it harder to push the case into the civil sphere.<\/li><\/ol>\n

    The report goes to the police, the prosecutor\u2019s office, the State Bureau of Investigation, NABU or the Bureau of Economic Security, depending on jurisdiction (Art. 216 CPC). Choosing the wrong body is not a ground for refusal: they must register the report and pass it on, but it takes longer.<\/p>\n

    What to do if they will not register it<\/h2>\n
    Art. 303(1)(1) CPC<\/b>A complaint to the investigating judge about inaction.<\/strong> This is the mechanism that works: failure to enter details in the Register is expressly listed among the decisions, acts and omissions that can be challenged during the pre-trial investigation.<\/span><\/div>\n

    Having heard the complaint, the court orders<\/strong> the details to be entered in the register. The investigating judge\u2019s ruling is binding, and after it the details are entered within the same 24 hours.<\/p>\n

    The complaint needs proof that the report was filed<\/strong> (the receipt slip, the postal receipt with the inventory, the acknowledgement stamp) and confirmation that the details were not entered<\/strong> (an extract from the Register, or the absence of a reply within the statutory period). Without proof of filing there is nothing to challenge, so recording the application matters as much as the wording of the report itself.<\/p>\n
