The state <strong>is obliged to compensate<\/strong> for the harm caused by the unlawful actions of the pre-trial investigation authorities, the prosecution service and the court. And it does so <strong>regardless of the fault<\/strong> of any particular investigator or prosecutor.<\/p>\n<p>Compensation for damage caused by the state is a separate procedure with its own time limits. It must be initiated; one should not wait for the state to remember the person it has held under suspicion for years.<\/p>\n<p>Most people who have been subjected to unlawful prosecution are simply glad that it is all over \u2014 and do not make a claim. The money to which they are legally entitled remains in the state budget.<\/p>\n<p><strong><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/strong><\/p>\n<h2>When is one entitled to compensation?<\/h2>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><strong>an acquittal<\/strong> that has become final;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>the closure of criminal proceedings on grounds of rehabilitation<\/strong> \u2014 absence of a criminal act, absence of the elements of an offence, or failure to prove the person\u2019s involvement;<\/li>\n<li><strong>the quashing of an unlawful conviction<\/strong> followed by the closure of the case;<\/li>\n<li><strong>a finding that the arrest, detention or search was unlawful<\/strong>;<\/li>\n<li><strong>the unlawful imposition<\/strong> of administrative arrest or corrective labour.<\/li>\n<\/ul>\n<p><strong>Important:<\/strong> if proceedings are closed on <strong>non-rehabilitative<\/strong> grounds (for example, due to the expiry of the limitation period, amnesty, or reconciliation), the right to compensation usually <strong>does not arise<\/strong>. This is a fundamental difference, and it is precisely this that must be checked first.<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/shkoda-derzhava-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-3996\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/shkoda-derzhava-infografika.svg\" alt=\"Compensation for damage caused by public authorities\" \/><\/a><\/p>\n<h2>What is compensable<\/h2>\n<p><strong>Earnings and other income<\/strong> lost as a result of unlawful actions \u2014 for the entire period.<\/p>\n<p><strong>Property<\/strong> \u2014 confiscated, seized and not returned, or forfeited to the state.<\/p>\n<p><strong>Fines and legal costs<\/strong> imposed in accordance with an unlawful judgement.<\/p>\n<p><strong>Legal aid costs<\/strong> \u2014 lawyers\u2019 fees paid in a case that was found to be unlawful.<\/p>\n<p><strong>Non-pecuniary damage<\/strong> \u2014 for suffering caused by unlawful persecution: loss of reputation, breakdown of relationships, stress, health consequences, time spent in pre-trial detention.<\/p>\n<p><strong>Restoration of employment and pension rights<\/strong> \u2014 reinstatement at work, recognition of length of service, restoration of housing rights.<\/p>\n<h2>Amount of non-pecuniary damage<\/h2>\n<p>There is an important point to note here: the amount of compensation for non-pecuniary damage in cases of unlawful prosecution <strong>is not plucked out of thin air<\/strong> \u2014 the law establishes a <strong>minimum benchmark<\/strong>, linked to the minimum wage for <strong>each month<\/strong> spent under investigation, on trial or in prison.<\/p>\n<p>This means that even without \u2018dramatic\u2019 evidence, a person who has spent a year under unlawful prosecution is entitled to a substantial sum.<\/p>\n<p>Any amount above this minimum must be substantiated by evidence: medical records, certificates of job loss, media reports, and evidence of the breakdown of family relationships.<\/p>\n<h2>Time limits: the main pitfall<\/h2>\n<p>The time limit for filing a claim is limited and is calculated <strong>from the moment the acquittal or the decision to close the proceedings comes into legal force<\/strong>.<\/p>\n<p>This is the most common reason why people are left empty-handed: the case is over, the person has breathed a sigh of relief, a year has passed \u2014 and the right to claim compensation can no longer be exercised.<\/p>\n<p>That is why the first thing we do is <strong>calculate the time limit<\/strong>. If it is about to expire, we act swiftly.<\/p>\n<h2>Procedure for compensation<\/h2>\n<ol>\n<li><strong>Verification of the grounds<\/strong> \u2014 whether the grounds for closing the case are rehabilitative or non-rehabilitative. This determines everything.<\/li>\n<li><strong>Calculation of amounts<\/strong> \u2014 earnings, property, fines, legal fees, and non-pecuniary damage.<\/li>\n<li><strong>Submission<\/strong> of a claim for compensation to the relevant authority.<\/li>\n<li><strong>Court<\/strong> \u2014 if your claim has been refused, is being delayed, or the amount awarded is unsatisfactory.<\/li>\n<li><strong>Enforcement of the judgment<\/strong> \u2014 compensation is paid from the State Budget.<\/li>\n<\/ol>\n<h2>Separately: damage caused by other public authorities<\/h2>\n<p>The right to compensation is not limited to criminal cases. Damage caused by unlawful decisions, actions or omissions <strong>of any state authority<\/strong> or local government body is also compensated by the state (Articles 1173\u20131174 of the Civil Code).<\/p>\n<p>Examples: unlawful refusal to grant a permit, unjustified obstruction of activities, an unlawful decision by an authority that has been overturned by a court, as a result of which you have suffered losses.<\/p>\n<h2>When a solicitor is not needed<\/h2>\n<p>If the authority has recognised the right to compensation and has itself paid an adequate sum, the matter is settled.
