An investigator runs dozens of cases at once, and the one that is not moving quietly stalls and is then closed because no offence was made out.<\/p>\n<p>Helping a victim in criminal proceedings comes down to three things: getting the case registered and investigated, getting the classification to match what actually happened, and getting you <strong>real money<\/strong>, not just a conviction.<\/p>\n<div class=\"sb-stat\"><b>0 UAH<\/b><span>And the main thing most people do not know: <strong>a civil claim within criminal proceedings is filed without paying any court fee<\/strong> (Art. 5(1)(6) of the Law \u201cOn Court Fees\u201d). A victim who files no applications and watches no deadlines becomes a spectator in their own case.<\/p><\/div><\/div>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/poterpilyj-infografika-en.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-5354\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/poterpilyj-infografika-en.svg\" alt=\"A victim\u2019s lawyer: rights, a civil claim free of court fees, challenging the closure of a case\" \/><\/a><\/p>\n<h2>What usually goes wrong, and what to do about it<\/h2>\n<div class=\"sb-path\"><div class=\"sb-path__head\"><h3 class=\"sb-path__title\">The report is not entered in the Register<\/h3><span class=\"sb-chip sb-chip--fast\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"12\" cy=\"12\" r=\"9\"\/><path d=\"M12 7v5l3 2\"\/><\/svg>24 hours to register<\/span><\/div><p>Details of a criminal offence are entered in the Unified Register of Pre-Trial Investigations without delay, and in any event within 24 hours of the report (Art. 214(1) CPC). In practice what you hear instead is \u201cwe\u2019ll look into it\u201d, \u201cwrite it differently\u201d, \u201cthis isn\u2019t our area\u201d.<\/p>\n<div class=\"sb-path__note\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3 2 20h20z\"\/><path d=\"M12 10v5M12 17.6v.4\"\/><\/svg><div><strong>What we do:<\/strong> file the report in writing with proof of filing (the registry, or a registered letter with an inventory of the contents), and challenge the inaction before the investigating judge. The court then orders the details to be entered in the <a href=\"https:\/\/svaroglaw.com\/en\/kryminalne-pravo\/advokat-po-yerdr\/\">Register<\/a>.<\/div><\/div><\/div><div class=\"sb-path\"><div class=\"sb-path__head\"><h3 class=\"sb-path__title\">The case is closed<\/h3><span class=\"sb-chip sb-chip--fast\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"12\" cy=\"12\" r=\"9\"\/><path d=\"M12 7v5l3 2\"\/><\/svg>10 days to complain<\/span><\/div><p>A decision to close the case is challenged before the investigating judge within 10 days of receiving it (Arts. 303, 304 CPC). The grounds for quashing it are usually plain from the file itself: witnesses not questioned, no expert report ordered, documents not obtained, camera footage not seized. Quashing the decision sends the case back for investigation.<\/p><\/div><div class=\"sb-path\"><div class=\"sb-path__head\"><h3 class=\"sb-path__title\">The investigation has stalled<\/h3><span class=\"sb-chip sb-chip--slow\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"12\" cy=\"12\" r=\"9\"\/><path d=\"M12 7v5l3 2\"\/><\/svg>no deadline<\/span><\/div><p>An investigator\u2019s inaction \u2014 failing to take the steps required \u2014 can be challenged throughout the <a href=\"https:\/\/svaroglaw.com\/en\/kryminalne-pravo\/zahyst-na-stadiyi-dosudovogo-rozsliduvannya\/\">pre-trial investigation<\/a>. Written applications work better than phone calls here: in one case about bodily injuries the expert report was ordered only after the fourth written application, the investigator having \u201cseen no grounds\u201d until then.<\/p><\/div>\n<h2>The civil claim: how to get the money<\/h2>\n<p>The civil claim is brought within the criminal proceedings before the trial begins (Art. 128(1) CPC), free of court fees. That is exactly why the documents needed to calculate the loss should be gathered while the investigation is still running.<\/p>\n<p><strong>What can be recovered:<\/strong><\/p>\n<ul class=\"sb-ilist\"><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h12v18l-2-1.5L14 21l-2-1.5L10 21l-2-1.5L6 21z\"\/><path d=\"M9 8h6M9 12h6M9 16h4\"\/><\/svg><\/span><span><strong>pecuniary loss<\/strong>: treatment, rehabilitation, repairs, the value of property destroyed, funeral expenses;<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M3 5l6 6 4-4 8 8\"\/><path d=\"M15 15h6V9\"\/><\/svg><\/span><span><strong>lost earnings<\/strong> for the whole period of incapacity;<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"9\" cy=\"8\" r=\"3.4\"\/><path d=\"M2.6 20a6.4 6.4 0 0 1 12.8 0\"\/><circle cx=\"17.5\" cy=\"9\" r=\"2.4\"\/><path d=\"M16 14.4A5 5 0 0 1 22 19\"\/><\/svg><\/span><span><strong>non-pecuniary damage<\/strong> for physical and mental suffering (Art. 23 CC).<\/span><\/li><\/ul>\n<p><strong>What determines the amount:<\/strong> medical records, receipts, income certificates, expert reports, evidence of the consequences. A figure plucked out of the air ends in a token award. The court sets non-pecuniary damage at its own discretion, and awards in similar cases differ several-fold, so we give a realistic figure after reviewing recent judgments in the register.<\/p>\n<p><strong>Against whom:<\/strong> against the accused, and in some cases against the person who is answerable in law for their acts, an employer for example (Art. 128(1) CPC).<\/p>\n<h2>A reconciliation agreement: how to do the arithmetic<\/h2>\n<p>The accused may offer a reconciliation agreement with full compensation. The first reaction is usually emotional: \u201cno deals, let him serve his time\u201d. Here is how to count it:<\/p>\n<ul class=\"sb-ilist\"><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 19V5M6 11l6-6 6 6\"\/><\/svg><\/span><span><strong>under an agreement<\/strong> you get the money now, and on paper;<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h12M6 21h12\"\/><path d=\"M8 3v3l4 5 4-5V3M8 21v-3l4-5 4 5v3\"\/><\/svg><\/span><span><strong>under a judgment<\/strong> you get a writ of execution and then years of enforcement in which the convicted person \u201chas no property\u201d;<\/span><\/li><li><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M14.5 3.5 20.5 9.5l-3 3-6-6z\"\/><path d=\"M11 7 4 14l3 3 7-7\"\/><path d=\"M3 21h10\"\/><\/svg><\/span><span><strong>the court<\/strong> may impose a sentence that does not involve imprisonment, and your consent will not be sought.<\/span><\/li><\/ul>\n<p>We set out both scenarios with the figures and the timescales; the decision is yours. The lawyer\u2019s job is to see that the terms of the agreement are performed.<\/p>\n<div class=\"sb-case\"><div class=\"sb-case__head\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3l8 3v6c0 5-3.5 8-8 9-4.5-1-8-4-8-9V6z\"\/><path d=\"M9 12l2 2 4-4\"\/><\/svg><\/span><h2 class=\"sb-case__title\">A case from our practice<\/h2><\/div><p>In 2025 a woman came to us after being knocked down on a pedestrian crossing: a fracture, six weeks off work, and a driver who at first promised to \u201csort everything out\u201d and then stopped answering. The case had been opened, but for two months nothing was done in it. We applied for a forensic medical report and for the camera footage to be obtained, and when that was refused we challenged the inaction before the investigating judge. The report was carried out, the degree of injury was confirmed, and the civil claim for treatment, lost earnings and non-pecuniary damage went in straight away. The case ended in a reconciliation agreement with payment before judgment; about seven months passed between the first approach and the money.
