This is a simple rule, and as long as there is only one heir, it works automatically.<\/p>\n<p>Problems arise when there are several heirs and the property <strong>cannot be divided<\/strong>: one flat for three children, one car, one share in a business. It is physically impossible to divide these things in half \u2014 and this is precisely where families end up arguing for years.<\/p>\n<p>The division of an estate in accordance with the law can be formalised in two ways: <strong>by an agreement between the heirs<\/strong> drawn up by a notary \u2014 quickly and cheaply \u2014 or <strong>through the courts<\/strong> \u2014 when an agreement cannot be reached.<\/p>\n<p><strong><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/strong><\/p>\n<h2>Five orders of succession<\/h2>\n<p>Each subsequent class inherits <strong>only in the absence<\/strong> of heirs from the previous class (Articles 1261\u20131265 of the Civil Code):<\/p>\n<ol>\n<li><strong>the testator\u2019s children<\/strong> (including those conceived during the testator\u2019s lifetime and born after their death), the surviving <strong>spouse<\/strong>, <strong>parents<\/strong>;<\/li>\n<li><strong>full brothers and sisters<\/strong>, <strong>grandmothers and grandfathers<\/strong> on both sides;<\/li>\n<li><strong>full uncles and aunts<\/strong>;<\/li>\n<li>persons who <strong>lived with the testator as part of the same household for at least five years<\/strong> prior to the opening of the succession;<\/li>\n<li>other <strong>relatives up to the sixth degree of kinship<\/strong>, as well as <strong>dependants<\/strong> of the testator.<\/li>\n<\/ol>\n<p><strong>Grandchildren inherit by right of representation<\/strong> \u2014 that is, the share of their deceased father or mother, if they predeceased the testator.<\/p>\n<p><strong>The fourth class<\/strong> \u2014 the most interesting and least well-known: a civil partner with whom a person has lived for more than five years is entitled to an inheritance if there are no heirs in the first three classes. However, the fact of cohabitation must be <strong>proven in court<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/podil-spadshchyny-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-3879\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/podil-spadshchyny-infografika.svg\" alt=\"Division of an estate by law: the five classes of heirs and how to divide indivisible property\" \/><\/a><\/p>\n<h2>When shares are not equal<\/h2>\n<p>Equal shares are the rule, but there are exceptions:<\/p>\n<ul>\n<li><strong>a change in order of succession by agreement.<\/strong> Heirs may agree in writing (before a notary) on a different distribution \u2014 this is a quicker route than going to court;<\/li>\n<li><strong>a change in the order of succession by court order.<\/strong> A person may be recognised as an heir in the order that is already inheriting if they have, for a long time, <strong>looked after the testator<\/strong>, cared for them during illness, and provided for them financially (Article 1259 of the Civil Code). This is a practical mechanism for those who have looked after an elderly person for years, whilst the estate is being divided amongst relatives who were never present;<\/li>\n<li><strong>disinheritance<\/strong> (Article 1224 of the Civil Code) \u2014 a court may disinherit a person who has evaded the obligation to support the testator, or who has intentionally taken the testator\u2019s life or prevented the drawing up of a will.<\/li>\n<\/ul>\n<h2>How to divide indivisible property<\/h2>\n<p>An flat cannot be divided up. The law provides several mechanisms:<\/p>\n<p><strong>An agreement on the division of the estate.<\/strong> The heirs agree amongst themselves who gets what \u2014 it does not necessarily have to be divided equally. One takes the flat, another takes money and compensation. The agreement must be notarised (mandatory for property). This is the quickest and cheapest option.<\/p>\n<p><strong>Allocation of a share in kind<\/strong> \u2014 if technically possible (for example, a house with two entrances).<\/p>\n<p><strong>Awarding the property to one heir with compensation for the others.<\/strong> Through the courts, with a mandatory valuation of the property.<\/p>\n<p><strong>Joint partial ownership.<\/strong> The worst-case scenario: everyone becomes a co-owner, and no one can dispose of the property without the others\u2019 consent. They live like this for years \u2014 and then end up in court anyway.<\/p>\n<h2>What makes the case complicated<\/h2>\n<ul>\n<li><strong>the heir cannot be contacted<\/strong> or lives abroad;<\/li>\n<li><strong>the property is being concealed<\/strong> \u2014 the other heirs \u2018forget\u2019 to disclose some of the assets;<\/li>\n<li><strong>the property is not registered<\/strong> in the deceased\u2019s name (a non-privatised flat, a garage without documents, land without a state title deed) \u2014 first, one has to <a href=\"https:\/\/svaroglaw.com\/en\/advokat-z-neruhomosti\/vyznannya-prava-vlasnosti\/\">establish ownership<\/a> in court<a href=\"https:\/\/svaroglaw.com\/en\/advokat-z-neruhomosti\/vyznannya-prava-vlasnosti\/\">;<\/a><\/li>\n<li><strong>the six-month deadline<\/strong> for accepting the inheritance has been missed;<\/li>\n<li><strong>the valuation is too low<\/strong> \u2014 and the person receiving the compensation loses out;<\/li>\n<li><strong>a business forming part of the estate<\/strong> \u2014 the most complex category to value.<\/li>\n<\/ul>\n<h2>Searching for property: something we do, not the notary<\/h2>\n<p>The notary works with whatever is presented to them. We <strong>search for<\/strong>: legal enquiries to the State Register of Property Rights, the Vehicle Register, banks, the Unified State Register, and the Inheritance Register.<\/p>\n<p>Very often, assets are discovered that the family were unaware of: bank accounts, a share in a limited liability company, a plot of land in another region, or a car registered in the testator\u2019s name. And just as often \u2014 assets that other heirs have deliberately concealed.<\/p>\n<h2>When a solicitor isn\u2019t needed<\/h2>\n<p>There are two heirs, both agree, the assets are registered, and the deadline hasn\u2019t been missed \u2014 go to a notary and sign a partition agreement. It\u2019s quick and cheap.
