To obtain compensation for damage, it is essential to know exactly how to draft a claim and what to do in the event of a refusal.<\/p>\n<h2>Non-pecuniary damage and its extent<\/h2>\n<p>Non-pecuniary damage refers to non-material costs. These relate to a person\u2019s physical pain and suffering. Compensation is awarded for non-pecuniary damage resulting from the following unlawful acts:<\/p>\n<ul>\n<li aria-level=\"1\">humiliation of a person\u2019s honour and dignity;<\/li>\n<li aria-level=\"1\">destruction of a person\u2019s or company\u2019s business reputation;<\/li>\n<li aria-level=\"1\">unlawful conduct resulting in mental suffering;<\/li>\n<li aria-level=\"1\">damage to health or injury causing a person to suffer;<\/li>\n<li aria-level=\"1\">damage to property that has affected the person\u2019s mental state.<\/li>\n<\/ul>\n<p>The extent of non-pecuniary damage is determined by the victim\u2019s claims. To satisfy these claims, the court may order the payment of a specific sum of money, property or other material\/non-material compensation.<\/p>\n<p>To determine non-pecuniary damage, the following are taken into account:<\/p>\n<ul>\n<li aria-level=\"1\">the extent of the victim\u2019s suffering;<\/li>\n<li aria-level=\"1\">the nature of the offence committed;<\/li>\n<li aria-level=\"1\">the degree of the defendant\u2019s guilt;<\/li>\n<li aria-level=\"1\">the extent of the victim\u2019s loss of physical abilities.<\/li>\n<\/ul>\n<h2>Compensation for non-pecuniary damage<\/h2>\n<p>Compensation for non-pecuniary damage can be obtained on the basis of evidence gathered to prove its existence.
