It reviews <strong>the procedure<\/strong>: whether you were examined by all the required doctors, whether the prescribed tests were carried out, whether the documents were completed correctly, and whether the medical reports you provided were taken into account.<\/p>\n<p>This is precisely why cases are won not by complaints about one\u2019s state of health, but on the basis of procedural irregularities. A telling example: in February 2026, the Mykolaiv District Administrative Court overturned the Medical Examination Commission\u2019s decision because the examination had not been carried out in full \u2014 the mandatory laboratory and diagnostic tests required by Regulation No. 402 had not been performed.<\/p>\n<p>You need a specialist lawyer for Medical Examination Commission cases to turn your medical documents into legal arguments \u2014 and to do so within the time limits, which are fast approaching.<\/p>\n<p><strong><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/strong><\/p>\n<h2>What conclusions does the Medical Examination Commission currently reach?<\/h2>\n<p>The status <strong>\u2018limited fitness\u2019 has been abolished<\/strong> by Law No. 3621-IX (with effect from 4 May 2024). The commission now issues one of the following conclusions:<\/p>\n<ul>\n<li><strong>fit for military service<\/strong> \u2014 including in combat units;<\/li>\n<li><strong>fit for service in military support units<\/strong> \u2014 rear services, logistics, communications, training centres, technical training centres, medical units (this is what has replaced \u2018limited fitness\u2019);<\/li>\n<li><strong>temporarily unfit<\/strong> \u2014 requires treatment, followed by a re-examination;<\/li>\n<li><strong>unfit for military service with removal from military registration<\/strong> \u2014 not subject to mobilisation.<\/li>\n<\/ul>\n<p>Individuals who previously held the status \u2018unfit in peacetime, limitedly fit in wartime\u2019 were required to undergo <strong>a re-examination<\/strong>. If you have not done so, this constitutes a separate risk and must be assessed alongside the Medical Examination Commission\u2019s decision.<\/p>\n<h2>When should a Medical Examination Commission decision be appealed?<\/h2>\n<p>Not every decision. To be honest: if the examination was carried out in full, all documents were taken into account, and the conclusion complies with the Schedule of Diseases \u2014 there is no point in taking legal action.<\/p>\n<p>An appeal has a chance of success when:<\/p>\n<ul>\n<li><strong>the examination was not carried out in full<\/strong> \u2014 mandatory tests (MRI, CT, blood tests) stipulated by Regulation No. 402 were not performed;<\/li>\n<li><strong>there was no specialist doctor<\/strong> \u2014 you have heart problems, but there was no cardiologist on the panel;<\/li>\n<li><strong>your medical records were ignored<\/strong> \u2014 discharge summaries, doctors\u2019 reports, test results;<\/li>\n<li><strong>the relevant article of the Schedule of Diseases was incorrectly applied<\/strong>;<\/li>\n<li><strong>the causal link was incorrectly established<\/strong> \u2014 a combat injury was recorded as \u2018domestic\u2019 or \u2018an illness not related to military service\u2019. This directly affects your benefits and status;<\/li>\n<li><strong>errors in the documents<\/strong> \u2014 in the data, dates, wording of the category, or review periods;<\/li>\n<li><strong>you were not issued a copy<\/strong> of the report or were not allowed to submit comments.<\/li>\n<\/ul>\n<p>You can appeal <strong>in both directions<\/strong>: both when an unfit person has been deemed fit, and vice versa \u2014 when the conclusion prevents the decision you require.<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/vlk-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-3769\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/vlk-infografika.svg\" alt=\u2018Lawyer specialising in the Medical Examination Commission: the commission\u2019s conclusions following the revocation of \u2018limited fitness\u2019 status and two avenues of appeal\u2019 \/><\/a><\/p>\n<h2>Two avenues of appeal<\/h2>\n<h3>Pre-trial \u2014 to the higher Medical Examination Commission<\/h3>\n<p>The appeal is lodged with the higher-level commission: against a decision of the Medical Examination Commission at a district or city Military Registration and Enlistment Office \u2014 to <strong>the regional Medical Examination Commission<\/strong>, against a decision of the regional commission \u2014 to <strong>the Central Medical Examination Commission of the Ministry of Defence<\/strong>.<\/p>\n<p>The following must be attached to the appeal: a copy of the contested decision, all medical documents, and a copy of the military registration document. It must be submitted in person or by registered post with a list of contents.<\/p>\n<p>This is the quicker and simpler route, and it is advisable to start with it. The outcome is the overturning of the decision and the scheduling of a repeat (follow-up) examination.<\/p>\n<h3>Court proceedings \u2014 administrative claim<\/h3>\n<p>The Medical Examination Commission is a public authority, so its decisions are appealed under the rules of the Code of Administrative Procedure.<\/p>\n<ul>\n<li><strong>Time limit<\/strong> \u2014 6 months from the date on which the person became aware of the violation of their right (Article 122 of the Code of Administrative Procedure).\n <\/li>\n<li><strong>Court fee<\/strong> \u2014 0.4 times the minimum subsistence level, i.e. <strong>1,331.20 UAH<\/strong> in 2026.<\/li>\n<li><strong>What the court examines<\/strong> \u2014 the legality of the procedure, not the medical substance of the conclusion.<\/li>\n<\/ul>\n<p><strong>Critically important:<\/strong> an appeal <strong>does not automatically suspend<\/strong> the effect of the Medical Examination Commission\u2019s decision. This means that whilst the proceedings are ongoing, you may be sent back to your unit. Therefore, in parallel with the appeal, you must work with the Territorial Medical Commission and, if necessary, apply for interim relief.<\/p>\n<h2>What decides the case<\/h2>\n<p>Not emotions, but evidence:<\/p>\n<ul>\n<li><strong>extracts from medical records<\/strong>, MRI and CT scan results, and test results;<\/li>\n<li><strong>opinions from independent specialist doctors<\/strong>;<\/li>\n<li><strong>written records of any irregularities<\/strong> observed during the examination \u2014 a verbal outburst in the examination room has no legal standing;<\/li>\n<li><strong>a copy of the Medical Examination Commission\u2019s report or the medical certificate<\/strong> \u2014 request this immediately; it is your key document;<\/li>\n<li><strong>evidence that your documents were not taken into account<\/strong>.<\/li>\n<\/ul>\n<p>Therefore, our first piece of advice is: <strong>obtain a copy of the report and record everything in writing<\/strong> \u2014 even before consulting a solicitor.<\/p>\n<h2>When a solicitor is not needed<\/h2>\n<p>If the examination was carried out thoroughly, all documents were taken into account, and the report accurately reflects your actual condition \u2014 there is nothing to challenge. You must therefore act quickly and resolve the issue with the Territorial Medical Commission at the same time.<\/p>\n<h3>Does the court assess my diagnosis?<\/h3>\n<p>No. The court checks the legality of the procedure: whether you were examined by all the necessary doctors, whether the mandatory tests were carried out, and whether the documents were drawn up correctly.<br \/>\n The court does not re-evaluate the medical substance of the conclusion.<\/p>\n<h3>How much does a judicial appeal against the Medical Examination Commission cost?<\/h3>\n<p>The court fee is 1,331.20 UAH (2026). Plus the lawyer\u2019s fee. An appeal to the Higher Medical Examination Commission is free of charge.<\/p>\n<h3>What is the time limit for a judicial appeal?<\/h3>\n<p>Six months from the date on which you became aware of the infringement of your rights (Article 122 of the Code of Administrative Procedure). However, you should not delay: the sooner you act, the better your chances of a successful defence.<\/p>\n<h3>What should you do if you are not provided with a copy of the Medical Examination Commission\u2019s report?<\/h3>\n<p>Request it in writing. Failure to provide a copy is in itself a breach and an additional ground for appeal. We will submit a solicitor\u2019s request.<\/p>\n<h3>Can I appeal the report if I have been deemed fit for service but I have a serious illness?<\/h3>\n<p>Yes, and this is the most common type of case.
