Exhaustion, a conflict with a commander or an offer of civilian work are not on that list.<\/p>\n<p>Where a ground <strong>does<\/strong> exist, refusals happen for three reasons: the application was never registered, the <a href=\"https:\/\/svaroglaw.com\/en\/vijskovyj-advokat\/advokat-po-vlk\/\">medical board<\/a> reached a different conclusion, or the relative\u2019s disability certificate expired during the weeks of waiting. Discharge on health grounds rests on a single document \u2014 the board\u2019s finding of unfitness. A medical file alone produces no order, however serious the diagnoses. Likewise a disability rating does not by itself discharge anyone: the serviceman is referred to the board, and it is the board\u2019s finding that becomes the ground.<\/p>\n<p><strong>On family grounds<\/strong> (Art. 26(4)) discharge is available, among others, where:<\/p>\n<div class=\"sb-panel sb-panel--dark\">\n\t\t\t<div class=\"sb-panel__head\">\n\t\t\t\t<span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M3 11 12 3l9 8\"\/><path d=\"M5 10v10h14V10\"\/><path d=\"M10 20v-6h4v6\"\/><\/svg><\/span>\n\t\t\t\t<h3 class=\"sb-panel__title\">Family grounds<\/h3>\n\t\t\t<\/div>\n\t\t\t\n\t\t\t<ul class=\"sb-plist\"><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 5v14M5 12h14\"\/><\/svg><span>there is a need to provide <strong>constant care for a close relative with a group I or II disability<\/strong>, and there is nobody else legally obliged to care for them;<\/span><\/li><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"9\" cy=\"8\" r=\"3.4\"\/><path d=\"M2.6 20a6.4 6.4 0 0 1 12.8 0\"\/><circle cx=\"17.5\" cy=\"9\" r=\"2.4\"\/><path d=\"M16 14.4A5 5 0 0 1 22 19\"\/><\/svg><span>there are <strong>three or more children<\/strong> under 18;<\/span><\/li><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3l8 3v6c0 5-3.5 8-8 9-4.5-1-8-4-8-9V6z\"\/><path d=\"M9 12l2 2 4-4\"\/><\/svg><span>the serviceman is <strong>raising a child with a disability<\/strong>;<\/span><\/li><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><circle cx=\"12\" cy=\"14.5\" r=\"6.5\"\/><path d=\"M9 7.5 10.5 4h3L15 7.5\"\/><\/svg><span>the serviceman is <strong>raising a child under 18 alone<\/strong> (the other parent has died, been deprived of parental rights, gone missing and so on);<\/span><\/li><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h12l4 6-10 12L2 9z\"\/><path d=\"M2 9h20M9 9l3 12 3-12\"\/><\/svg><span>the <strong>spouse has a group I or II disability<\/strong>;<\/span><\/li><li><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h8l4 4v14H6z\"\/><path d=\"M14 3v4h4M9 12h6M9 16h6\"\/><\/svg><span>the serviceman is a <strong>guardian or carer<\/strong> of someone needing constant care.<\/span><\/li><\/ul>\n\t\t<\/div>\n<p><strong>Other grounds<\/strong>: reaching the age limit for military service, and a custodial sentence that has come into force.<\/p>\n<div class=\"sb-note sb-note--warn\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3 2 20h20z\"\/><path d=\"M12 10v5M12 17.6v.4\"\/><\/svg><div class=\"sb-note__body\"><p>Every ground has conditions, and most refusals hide in those conditions. Caring for a father with a group II disability, for instance, gives no right to discharge if he has other adult children who are legally obliged to support him.<\/p><\/div><\/div>\n<h2>The procedure: five steps<\/h2>\n<ol class=\"sb-steps\"><li><strong>Evidence the ground.<\/strong> For health: attend the medical board and obtain a finding of unfitness. For family grounds: gather current certificates, birth and marriage records, register extracts, and the assessment team\u2019s report (since 2025 it replaced the old disability commission) that the relative needs constant care.<\/li><li><strong>File the application<\/strong> with the commander, and have it <strong>registered as an incoming document<\/strong>: number, date, clerk\u2019s signature. There is no such thing as an oral application, and \u201cI told him\u201d cannot be proved later.<\/li><li><strong>The commander considers it.<\/strong> The law sets no specific period for a discharge application; in litigation the benchmark is the one-month period for dealing with citizens\u2019 requests (Art. 20 of the Law \u201cOn Citizens\u2019 Appeals\u201d), after which silence is challenged as inaction.<\/li><li><strong>The discharge order<\/strong> and removal from the unit\u2019s personnel list.<\/li><li><strong>Settlement<\/strong>: pay, compensation for unused leave, issue of documents.<\/li><\/ol>\n<p>The commonest mistake in the applications we see: filing without the documents, \u201cjust to fix the date\u201d. Such an application is considered formally and refused.<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/zvilnennya-infografika-en.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-5386\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/zvilnennya-infografika-en.svg\" alt=\"Discharge from military service: health and family grounds\" \/><\/a><\/p>\n<h2>If the commander refuses or says nothing<\/h2>\n<div class=\"sb-cards sb-cards--2\"><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M6 3h12v18l-2-1.5L14 21l-2-1.5L10 21l-2-1.5L6 21z\"\/><path d=\"M9 8h6M9 12h6M9 16h4\"\/><\/svg><\/span><h3 class=\"sb-card__title\">Recording the filing<\/h3><div class=\"sb-card__body\"><p> The application must be registered: incoming number, date, signature. If it \u201cgets lost\u201d, we refile by post with a list of contents.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 19V5M6 11l6-6 6 6\"\/><\/svg><\/span><h3 class=\"sb-card__title\">Going up the chain<\/h3><div class=\"sb-card__body\"><p> Or applying to higher command.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M14.5 3.5 20.5 9.5l-3 3-6-6z\"\/><path d=\"M11 7 4 14l3 3 7-7\"\/><path d=\"M3 21h10\"\/><\/svg><\/span><h3 class=\"sb-card__title\">The administrative court<\/h3><div class=\"sb-card__body\"><p> A commander\u2019s decisions and inaction are challenged under the Code of Administrative Procedure. The court fee for such a claim is <strong>1,331.20 UAH<\/strong> (0.4 of a subsistence minimum in 2026), or 1,064.96 UAH through the Electronic Court. The court can declare the inaction unlawful and order the commander to decide the application on its merits within a set period.<\/p><\/div><\/article><article class=\"sb-card\"><span class=\"sb-icobox\"><svg class=\"sb-ico\" viewBox=\"0 0 24 24\" fill=\"none\" stroke=\"currentColor\" stroke-width=\"1.7\" stroke-linecap=\"round\" stroke-linejoin=\"round\" aria-hidden=\"true\" focusable=\"false\"><path d=\"M12 3 2 20h20z\"\/><path d=\"M12 10v5M12 17.6v.4\"\/><\/svg><\/span><h3 class=\"sb-card__title\">A warning<\/h3><div class=\"sb-card__body\"><p> Leaving the unit without permission because of an \u201cunfair refusal\u201d carries separate liability under Art. 407(5) of the Criminal Code (<a href=\"https:\/\/svaroglaw.com\/en\/vijskovyj-advokat\/advokat-po-szch-ta-dezertyrstvu\/\">martial law conditions<\/a>): five to ten years\u2019 imprisonment.<\/p><\/div><\/article><\/div>\n<h2>Discharge on health grounds: the board decides everything<\/h2>\n<p>If the medical board has found you <strong>fit<\/strong> or <strong>fit with limitations<\/strong>, an application for discharge on health grounds will not be considered, whatever the diagnoses.<\/p>\n<p>So the work starts not with the application but with <strong>challenging the board\u2019s decision<\/strong>: a complaint to a higher-level board or an <a href=\"https:\/\/svaroglaw.com\/en\/administrativni-spravi\/\">administrative claim<\/a>. The court reviews the <strong>procedure<\/strong> of the examination (whether all the relevant specialists saw the person, whether the mandatory tests were done, whether the medical records were taken into account); it does not re-assess the medical substance itself. He had filed his discharge application back in November 2024, but without registration, and had heard nothing in four months. We refiled by post with a list of contents, and after a month\u2019s silence brought an administrative claim to have the inaction declared unlawful. The court ordered the commander to decide the application within ten days; the discharge order on family grounds came through two and a half months after the claim was filed. The court fee was 1,331.20 UAH, with our work within the comprehensive administrative case rate.
