Personal disagreement, fatigue, a conflict with a commander or a desire to move into civilian work do not constitute grounds \u2014 and no lawyer can change that.<\/p>\n<p>But when there <strong>is<\/strong> a valid ground, the problem almost always lies not with the law, but with the paperwork and procedure: the report was not registered, the Medical Examination Commission gave the wrong conclusion, a relative\u2019s disability certificate has expired, or the commander has remained silent for months.<\/p>\n<p>Discharge from military service on health grounds hinges on a single document \u2014 <strong>the Medical Examination Board\u2019s conclusion of unfitness<\/strong>. Discharge on family grounds is based on a set of documents confirming the grounds at the <strong>time the report is considered<\/strong>.<\/p>\n<p><strong><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/strong><\/p>\n<h2>Main grounds for discharge<\/h2>\n<p><strong>On health grounds<\/strong> \u2014 based on the Medical Examination Commission\u2019s conclusion regarding <strong>unfitness for military service with removal from military register<\/strong>. This is the only way: without the relevant Medical Examination Commission\u2019s report, discharge on health grounds is not possible, no matter how serious the diagnoses in the medical records may be.<\/p>\n<p><strong>Due to family circumstances<\/strong> \u2014 the most common grounds:<\/p>\n<ul>\n<li>the need <strong>to care for a person with a Group I or II disability<\/strong> (in the absence of other persons obliged to provide care);<\/li>\n<li><strong>three or more children<\/strong> under the age of 18;<\/li>\n<li><strong>raising a child with a disability<\/strong>;<\/li>\n<li><strong>raising a child as a single parent<\/strong>;<\/li>\n<li><strong>a spouse with a Group I or II disability<\/strong>;<\/li>\n<li><strong>care<\/strong> of a person requiring constant care.<\/li>\n<\/ul>\n<p><strong>Other grounds:<\/strong> reaching the maximum age for service; a conviction carrying a custodial sentence becoming final; recognition as a person with a disability.<\/p>\n<p>Each ground is subject to specific conditions, and it is within these that the majority of refusals lie. The most common example: caring for a parent with a disability does not entitle the person to discharge if there are other adult children obliged to care for them.<\/p>\n<h2>Discharge procedure<\/h2>\n<ol>\n<li><strong>Provide documentary evidence to substantiate the grounds.<\/strong> For health reasons \u2014 undergo a medical examination by the Medical Examination Commission and obtain a report. For family circumstances \u2014 gather up-to-date certificates, statements and extracts from registers.<\/li>\n<li><strong>Submit a report<\/strong> to the commander \u2014 with mandatory <strong>registration of the incoming document<\/strong>. There is no such thing as a verbal report; a report given \u2018verbally\u2019 cannot be substantiated later.<\/li>\n<li><strong>Consideration of the report<\/strong> by the commander and decision-making.<\/li>\n<li><strong>Order for discharge<\/strong> and removal from personnel records.<\/li>\n<li><strong>Settlement<\/strong> \u2014 payment of due funds, issue of documents.<\/li>\n<\/ol>\n<p>Key mistake: submitting a report without the required documents. Such a report will be considered merely as a formality and rejected \u2014 and time will be wasted.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/zvilnennya-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-3800\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/zvilnennya-infografika.svg\" alt=\"Discharge from military service: grounds relating to health and family circumstances\" \/><\/a><\/p>\n<h2>If the commander refuses or remains silent<\/h2>\n<p>This is the most common situation we are approached about.<\/p>\n<p><strong>Firstly \u2014 documentation.<\/strong> The report must be registered: reference number, date, signature. If the report has \u2018gone missing\u2019 \u2014 resubmit it by post with a list of contents. Without proof of submission, there is no point in appealing.<\/p>\n<p><strong>Next \u2014 submit a report to the next higher command<\/strong> or appeal to higher command.<\/p>\n<p><strong>Then \u2014 the administrative court.<\/strong> The commander\u2019s decision and failure to act may be challenged under the rules of the Code of Administrative Procedure. Court fees \u2014 <strong>1,331.20 UAH<\/strong> (0.4 times the minimum subsistence level in 2026). The court may rule that the inaction was unlawful and order the report to be considered on its merits.<\/p>\n<p><strong>Important:<\/strong> leaving one\u2019s unit without permission \u2018due to injustice\u2019 is not a solution, but a separate offence under <a href=\"https:\/\/svaroglaw.com\/en\/military-lawyer\/advokat-po-szch-ta-dezertyrstvu\/\">Article 407 of the Criminal Code<\/a> punishable by a sentence of 5 years or more. An unlawful refusal by a commander must be appealed against, not \u2018resolved\u2019 by deserting without authorisation.<\/p>\n<h2>Discharge on medical grounds: everything is decided by the Medical Examination Commission<\/h2>\n<p>If the Medical Examination Commission has deemed you <strong>fit for service<\/strong> \u2014 your request for discharge on medical grounds will not be considered, regardless of your diagnoses.<\/p>\n<p>Therefore, the process begins not with the application, but with <strong>appealing the Medical Examination Commission\u2019s conclusion<\/strong>: a complaint to a higher commission or an administrative claim.
