A relative\u2019s disability certificate has expired, guardian status has not been confirmed, details of children have not been entered into the register, and the employer has not made the necessary arrangements. The Territorial Recruitment Centre does not take your personal circumstances into account; it only considers what is in the documents and the register.<\/p>\n<p>A deferral from mobilisation is neither a privilege nor an \u2018arrangement\u2019. It is a right, confirmed by documents. And it is granted only when the grounds <strong>exist at the time of consideration<\/strong> and <strong>are supported by appropriate evidence<\/strong>.<\/p>\n<p>We do not \u2018arrange deferrals\u2019. We set out in writing the legal grounds you already possess \u2014 and challenge any refusal if it is unlawful.<\/p>\n<p><strong><a href=\"tel:380955545424\">+38 095 554-54-24<\/a> \u2014 legal advice<\/strong><\/p>\n<h2>Main grounds for deferral<\/h2>\n<p>The list is defined by law and is exhaustive. The most common grounds are:<\/p>\n<ul>\n<li><strong>caring for a person with a disability<\/strong> of Group I or II (provided there are no other persons obliged to support them);<\/li>\n<li><strong>raising a child with a disability<\/strong>;<\/li>\n<li><strong>three or more children<\/strong> under the age of 18;<\/li>\n<li><strong>raising a child alone<\/strong> \u2014 where the other parent is absent;<\/li>\n<li><strong>guardianship or care<\/strong> of a child;<\/li>\n<li><strong>health condition<\/strong> \u2014 as determined by the Medical Examination Commission;<\/li>\n<li><strong>pursuing education<\/strong> \u2014 on a full-time or dual-track basis;<\/li>\n<li><strong>academic and teaching staff<\/strong> at higher education institutions;<\/li>\n<li><strong>job retention<\/strong> at the place of work (a critically important enterprise);<\/li>\n<li><strong>close relatives of military personnel who have been killed<\/strong> or are missing in action.<\/li>\n<\/ul>\n<p>Each ground has its own conditions and exceptions \u2014 it is usually within these that the reason for refusal lies. For example, caring for a person with a disability does not qualify for a deferral if there are other relatives obliged to support them.<\/p>\n<h2>Why does the TCC refuse<\/h2>\n<p>Not because of \u2018arbitrariness\u2019, but most often due to defects in the documents:<\/p>\n<ul>\n<li><strong>the grounds are not supported by documentation<\/strong> \u2014 the fact exists, but the paperwork does not;<\/li>\n<li><strong>documents have expired<\/strong> \u2014 certificates from the Medical and Social Expertise Commission (MSEK), family composition certificates;<\/li>\n<li><strong>status has not been formalised<\/strong> \u2014 de facto guardianship exists, but there is no legal guardianship;<\/li>\n<li><strong>data is missing from the registers<\/strong> \u2014 \u2018Oberig\u2019, the register of persons with disabilities;<\/li>\n<li><strong>the reservation has not been processed<\/strong> by the employer or has been processed incorrectly;<\/li>\n<li><strong>the person did not apply in time<\/strong> \u2014 by the date specified in the summons.<\/li>\n<\/ul>\n<p>Therefore, 80 per cent of a lawyer\u2019s work here is not in court, but <strong>ensuring the correct set of documents<\/strong> is compiled, submitted on time and duly registered.<\/p>\n<h2>Procedure for processing<\/h2>\n<ol>\n<li><strong>Verification of the grounds<\/strong> \u2014 whether they exist in law, and not merely in fact. This is the most important step: sometimes it is necessary first to arrange guardianship, establish a fact or update a status.<\/li>\n<li><strong>Gathering documents<\/strong> \u2014 certificates, statements, extracts from registers, medical reports. All must be up to date as at the date of submission.<\/li>\n<li><strong>Submitting the application to the TCC<\/strong> \u2014 this must be done with registration of the incoming document or by post with a list of contents. Verbal requests have no legal force.<\/li>\n<li><strong>Updating details<\/strong> in the register \u2014 via \u2018Rezerv+\u2019 or in person.<\/li>\n<li><strong>Receiving a decision.<\/strong> A deferral is granted for a specified period and requires <strong>timely renewal<\/strong>.<\/li>\n<\/ol>\n<p><a href=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/vidstrochka-infografika.svg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-3786\" src=\"https:\/\/svaroglaw.com\/wp-content\/uploads\/2026\/07\/vidstrochka-infografika.svg\" alt=\"Deferral from mobilisation: grounds, reasons for refusal by the Territorial Recruitment Centre and the appeal procedure\" \/><\/a><\/p>\n<h2>If your application has been refused<\/h2>\n<p><strong>Step 1. Obtain a written refusal stating the grounds.<\/strong> A verbal statement such as \u2018you are not eligible\u2019 is not a decision and cannot be appealed. Demand a written document.<\/p>\n<p><strong>Step 2. Analyse the reason.<\/strong> If the refusal is due to missing documents, submit them. If the grounds for refusal are unfounded, appeal.<\/p>\n<p><strong>Step 3. Administrative proceedings.<\/strong> Decisions and omissions by the TCC may be challenged in the administrative court. Court fees amount to <strong>1,331.20 UAH<\/strong> (0.4 times the minimum subsistence level in 2026).<\/p>\n<p><strong>Step 4. Securing the claim.<\/strong> This is crucial: the mere fact of filing a claim does not automatically halt mobilisation. Therefore, an application to secure the claim must be submitted at the same time.<\/p>\n<p>Inaction on the part of the TCC (an application has been submitted but no decision has been made) is appealed in the same way as a refusal.<\/p>\n<h2>Extension of deferral<\/h2>\n<p>The deferral is not indefinite. The most common setbacks occur precisely when seeking an extension: a person has been granted a deferral, becomes complacent, and then the deadline expires, causing their status to be removed from the register.<\/p>\n<p>Extensions must be sought <strong>in good time<\/strong>, with an updated set of documents. We keep track of these deadlines on behalf of the client.<\/p>\n<h2>What we do not do<\/h2>\n<p>We <strong>do not purchase<\/strong> deferrals, do not arrange fictitious guardianship, do not \u2018negotiate\u2019 with the TCC, and do not fabricate non-existent diagnoses. These are criminal offences \u2014 for all parties involved, including the client.<\/p>\n<p>People who go down this path do not receive a deferral, but face criminal proceedings \u2014 and with it, everything they were trying to escape from.<\/p>\n<h2>When a solicitor is not needed<\/h2>\n<p>The grounds are clear, the documents are in order, and the register has been updated \u2014 submit the application yourself. The court may order the Military Registration and Enlistment Office to consider the application on its merits.<\/p>\n<h3>Is the deferral valid indefinitely?<\/h3>\n<p>No. It is granted for a fixed period and must be renewed in good time. An expired deferral is removed from the register, and the person is once again subject to mobilisation.<\/p>\n<h3>Is it possible to apply for a deferral whilst abroad?<\/h3>\n<p>Yes, documents are submitted via a representative acting under a power of attorney, and details are updated remotely.
